1. Introduction

Welcome to Art is Lit (“Art is Lit”, “we”, “us”, “our”).

These Artist Terms & Conditions (“Artist Terms”) govern your application to become an Artist and your ongoing use of the Art is Lit marketplace as a seller of artwork.

By applying to become an Artist, creating an Artist account, listing Artwork for sale or continuing to sell through the Platform, you confirm that you have read, understood and agree to be legally bound by these Artist Terms.

These Artist Terms form a legally binding agreement between you and Art is Lit.

They should be read together with our:

  • Marketplace Terms & Conditions
  • Privacy Policy
  • Cookie Policy
  • Return & Refund Policy
  • Shipping Policy
  • Artist Code of Conduct
  • Any additional policies published by Art is Lit from time to time.

Where there is any conflict between these Artist Terms and the Marketplace Terms & Conditions, these Artist Terms shall govern matters relating specifically to Artists.


2. Definitions

For the purposes of these Artist Terms:

Artist means an individual, sole trader, company or other legal entity approved by Art is Lit to sell Artwork through the Platform.

Artist Account means a registered seller account approved by Art is Lit.

Artwork means any creative work listed for sale through the Platform, including but not limited to:

  • Paintings
  • Drawings
  • Ceramics
  • Sculpture
  • Photography
  • Textile Art
  • Glass Art
  • Jewellery
  • Printmaking
  • Mixed Media
  • Digital Artwork
  • Limited Edition Prints
  • Handmade Crafts
  • Downloadable Digital Products
  • Any other creative works approved by Art is Lit.

Buyer means any customer purchasing Artwork through the Platform.

Commission means the percentage retained by Art is Lit from completed sales.

Platform means the Art is Lit website and all associated marketplace services.

Product Listing means any Artwork offered for sale through the Platform.

Stripe Connect means the payment processing system used to facilitate split payments and Artist payouts.


3. Eligibility

To become an Artist on Art is Lit you must:

  • be at least 18 years of age;
  • have the legal capacity to enter into binding contracts;
  • provide accurate and truthful registration information;
  • maintain an active email address;
  • provide payment details required for receiving payouts;
  • comply with all applicable laws and regulations;
  • comply with these Artist Terms and all Platform policies.

If you apply on behalf of a business, company or organisation, you confirm that you have the authority to bind that organisation to these Artist Terms.

Art is Lit reserves the right to refuse any application that does not satisfy these eligibility requirements.


4. Applying to Become an Artist

Submitting an application does not guarantee approval.

Art is Lit carefully curates its marketplace and considers each application individually.

When reviewing applications, we may consider factors including:

  • artistic originality;
  • craftsmanship;
  • quality of presentation;
  • professionalism;
  • product photography;
  • completeness of the application;
  • suitability for the Art is Lit marketplace.

Applicants may be asked to provide additional information before a decision is made.

Art is Lit reserves the right to approve or decline any application without providing reasons.


5. Artist Approval

Artists may only begin selling after receiving written approval from Art is Lit.

Approval may include the completion of additional verification checks.

Approval as an Artist:

  • does not guarantee future sales;
  • does not create employment;
  • does not create a partnership;
  • does not create an agency relationship;
  • does not grant exclusivity.

Art is Lit reserves the right to review Artist accounts periodically to ensure ongoing compliance with these Artist Terms.


6. Artist Verification

To protect Buyers, Artists and the integrity of the Platform, Art is Lit reserves the right to verify the identity of any Artist before or after approval.

Verification may include requesting:

  • government-issued photographic identification;
  • proof of address;
  • business registration documents;
  • tax registration details where applicable;
  • proof of ownership or authorship of Artwork;
  • evidence supporting claims of authenticity;
  • proof of limited edition numbering.

Art is Lit may also request additional documentation where it reasonably suspects:

  • fraudulent activity;
  • copyright infringement;
  • counterfeit Artwork;
  • misleading product descriptions;
  • identity theft;
  • money laundering;
  • breaches of applicable law.

Failure to cooperate with verification requests may result in:

  • delayed approval;
  • removal of listings;
  • temporary suspension;
  • delayed payouts;
  • permanent closure of an Artist account.

Verification by Art is Lit does not guarantee the identity, reliability or future conduct of an Artist and does not create any liability on the part of Art is Lit.


7. Artist Accounts

Artists are responsible for maintaining the security of their accounts and all activity carried out using their login credentials.

Artists agree to:

  • keep their contact information accurate and up to date;
  • maintain secure passwords;
  • notify Art is Lit immediately if they suspect unauthorised access to their account;
  • provide truthful information at all times.

Artists must not:

  • create multiple accounts without written permission;
  • share account credentials with another person;
  • transfer or sell their account;
  • impersonate another individual or business;
  • provide false or misleading information.

Artists remain responsible for all activity carried out through their account unless they have previously notified Art is Lit of unauthorised access.

Art is Lit reserves the right to suspend or terminate any Artist account that breaches these Artist Terms or where continued access may present a risk to the Platform or its users.


8. Our Relationship with Artists

Art is Lit operates as a marketplace facilitator, providing a platform that enables independent Artists to promote and sell their Artwork directly to Buyers.

Nothing in these Artist Terms creates a relationship of employment, partnership, agency, joint venture or franchise between Art is Lit and any Artist.

Artists operate as independent sellers and are solely responsible for:

  • their Artwork;
  • their business activities;
  • compliance with applicable laws;
  • taxes and financial obligations;
  • customer service relating to their products.

Artists have no authority to act on behalf of Art is Lit or to make representations or commitments in the name of Art is Lit unless expressly authorised in writing.

Art is Lit may curate the Platform, promote selected Artists and feature Artwork in marketing materials, but such promotion does not imply endorsement, guarantee of sales or any preferential contractual status.

9. Artist Responsibilities

Artists are solely responsible for the Artwork they list and sell through the Platform.

By listing Artwork for sale, you represent and warrant that you:

  • are the legal creator of the Artwork or have all necessary legal rights, licences and permissions to sell it;
  • own or have permission to use all photographs, videos, product descriptions and other content uploaded to the Platform;
  • provide accurate, truthful and complete information about your Artwork;
  • comply with all applicable laws and regulations relating to your business and products;
  • fulfil accepted orders promptly and professionally;
  • maintain appropriate business and financial records;
  • act honestly and in good faith when dealing with Buyers and Art is Lit.

Artists are solely responsible for:

  • the originality and legality of their Artwork;
  • pricing their products;
  • inventory management;
  • packaging and dispatch;
  • customer service;
  • product safety;
  • tax obligations;
  • compliance with consumer protection legislation.

Artists must not engage in any activity that may damage the reputation, integrity or security of Art is Lit.


10. Originality and Authenticity

Art is Lit is committed to showcasing original creativity and maintaining the trust of Buyers.

Artists warrant that all Artwork listed on the Platform is accurately described and represented.

Artists must clearly identify whether an item is:

  • an original work;
  • a limited edition;
  • an open edition;
  • a reproduction;
  • a commissioned piece;
  • a digital download.

Artists must never intentionally misrepresent:

  • reproductions as originals;
  • prints as hand-painted Artwork;
  • edition numbers;
  • provenance;
  • the materials used;
  • dimensions;
  • the condition of the Artwork.

Where appropriate, Artists are encouraged to provide a Certificate of Authenticity with original Artwork and limited editions.

Art is Lit reserves the right to request evidence supporting any claim relating to authenticity, originality or provenance.


11. Product Standards

Artists are expected to maintain high standards of quality across all products offered for sale.

Each Product Listing should include:

  • an accurate title;
  • a detailed description;
  • dimensions;
  • materials used;
  • weight where appropriate;
  • care instructions where applicable;
  • edition information;
  • dispatch times;
  • any important information that may influence a Buyer’s purchasing decision.

Artwork must:

  • match the Product Listing;
  • be safely packaged;
  • be fit for sale;
  • comply with applicable laws;
  • not infringe third-party rights.

Art is Lit reserves the right to request amendments to listings that do not meet marketplace standards.


12. AI-Generated and AI-Assisted Artwork

Art is Lit welcomes innovation while encouraging transparency.

Artists must clearly disclose where artificial intelligence has been used in the creation of Artwork.

Listings should accurately identify whether the Artwork is:

  • handmade;
  • traditionally created;
  • digitally created;
  • AI-assisted;
  • fully AI-generated.

Artists remain solely responsible for ensuring that AI-assisted or AI-generated Artwork:

  • complies with applicable copyright laws;
  • does not infringe third-party intellectual property rights;
  • is accurately described;
  • does not mislead Buyers.

Failure to disclose the use of artificial intelligence where it would reasonably affect a Buyer’s purchasing decision may result in the removal of listings or suspension of the Artist account.


13. Product Photography

High-quality photography is essential to maintaining Buyer confidence.

Artists must ensure that all photographs:

  • accurately represent the Artwork;
  • are clear and in focus;
  • are of sufficient quality to allow Buyers to assess the Artwork;
  • are not misleading.

Photographs must not be excessively edited in a way that materially alters:

  • colours;
  • textures;
  • finishes;
  • size;
  • condition.

If frames, mounts, easels or accessories shown in photographs are not included in the sale, this must be clearly stated within the Product Listing.

Artists warrant that they own or have permission to use every image uploaded to the Platform.


14. Pricing

Artists are responsible for setting the retail price of their Artwork.

Prices should:

  • be accurate;
  • clearly displayed;
  • reflect the Artwork being sold;
  • include all information necessary for Buyers to make an informed purchasing decision.

Artists may not artificially inflate prices before offering promotional discounts.

Art is Lit reserves the right to remove misleading pricing or obvious pricing errors.

Marketplace commission will be deducted from completed sales in accordance with these Artist Terms.


15. Inventory Management

Artists are responsible for maintaining accurate inventory levels.

Artwork listed as available should be ready for dispatch within the stated processing time.

If Artwork becomes unavailable, the Artist must immediately update the Product Listing.

Artists should avoid overselling products.

Repeated cancellations due to unavailable inventory may result in suspension or removal from the Platform.


16. Processing Orders

Artists are expected to process accepted orders promptly.

Artists should:

  • prepare orders within the stated processing time;
  • communicate any unexpected delays to the Buyer;
  • dispatch Artwork promptly after completion;
  • upload tracking information where available.

If an Artist is unable to fulfil an order, they must notify Art is Lit immediately.

Repeated late dispatches or cancellations may result in restrictions on the Artist account.


17. Packaging and Shipping

Artists are responsible for ensuring that Artwork is packaged securely and appropriately for transportation.

Packaging should be suitable for the size, weight and fragility of the Artwork.

Artists are strongly encouraged to use:

  • tracked delivery services;
  • appropriate insurance for valuable Artwork;
  • protective packaging materials.

Artists remain responsible for the Artwork until the shipping carrier confirms delivery.

Failure to package Artwork adequately may affect the outcome of damage claims or disputes.


18. Customer Service

Artists are expected to provide a professional standard of customer service.

Artists should:

  • respond to Buyer enquiries promptly;
  • communicate courteously and respectfully;
  • provide accurate information;
  • cooperate with Art is Lit during dispute investigations;
  • resolve issues in good faith wherever reasonably possible.

Repeated complaints regarding poor customer service may result in account review.


19. Communication with Buyers

Communication between Artists and Buyers should remain respectful, professional and relevant to the transaction.

Artists must not:

  • harass Buyers;
  • send unsolicited marketing messages;
  • request payment outside the Platform;
  • encourage Buyers to cancel Platform orders in favour of private sales;
  • attempt to avoid marketplace commission.

All communication should support a safe and trustworthy marketplace experience.

Art is Lit reserves the right to review communications where reasonably necessary to investigate complaints, suspected fraud or breaches of these Artist Terms, subject to applicable privacy laws.

Payments, Intellectual Property and Legal Responsibilities


20. Marketplace Commission

Art is Lit charges a marketplace commission on completed sales in exchange for providing the Platform, payment processing, marketplace management, marketing and related services.

Unless otherwise agreed in writing, the current marketplace commission is 15% of the final sale price of each completed order.

The applicable commission will be automatically deducted before any funds become eligible for payout to the Artist.

Art is Lit reserves the right to amend its commission rates or fee structure at any time. Any changes will be communicated to Artists in advance and will not apply retrospectively to orders already completed.


21. Payments and Stripe Connect

Payments made through the Platform are processed securely using approved third-party payment providers, including Stripe Connect.

When an order is placed:

  1. The Buyer pays securely through the Platform.
  2. Payment is authorised and held while the order is fulfilled.
  3. Art is Lit deducts its marketplace commission.
  4. The remaining balance is allocated to the Artist.
  5. Funds become eligible for release once the Buyer Inspection Period has expired and no qualifying dispute remains outstanding.

Artists acknowledge that payment processing services are provided by independent third-party providers and are subject to those providers’ own terms and conditions.

Art is Lit is not responsible for delays, failures or interruptions caused by payment providers.


22. Artist Payouts

Artist funds become eligible for payout only when:

  • payment has been successfully received from the Buyer;
  • the order has been marked as delivered by the shipping carrier;
  • the 48-hour Buyer Inspection Period has expired;
  • no dispute, return request, chargeback or fraud investigation is outstanding;
  • the Artist remains in compliance with these Artist Terms.

Art is Lit may temporarily delay or withhold payouts where reasonably necessary to investigate:

  • suspected fraud;
  • copyright complaints;
  • policy breaches;
  • chargebacks;
  • identity verification;
  • suspicious account activity.

Eligibility for payout does not guarantee immediate payment and remains subject to payment provider processing times and the Platform’s payout schedule.


23. Taxes and Financial Responsibilities

Artists are independent sellers and are solely responsible for their own tax and financial obligations.

This includes, where applicable:

  • income tax;
  • corporation tax;
  • VAT;
  • GST;
  • sales tax;
  • customs obligations;
  • business registrations;
  • accounting records;
  • compliance with local tax legislation.

Art is Lit does not provide tax, accounting or legal advice.

Artists are responsible for determining and complying with all tax obligations applicable in their own country or jurisdiction.


24. Returns and Refunds

Artists agree to comply with the Art is Lit Return & Refund Policy, which forms part of these Artist Terms.

Where a return is approved, Artists agree to:

  • cooperate with Art is Lit during the return process;
  • respond promptly to requests for information;
  • accept returned Artwork where required under the Return & Refund Policy;
  • process approved refunds in accordance with Platform procedures.

Artists acknowledge that Buyers have a 48-hour Buyer Inspection Period following confirmed delivery in which to report qualifying issues.

Claims made after the Buyer Inspection Period will generally not be accepted unless required by applicable law.


25. Chargebacks and Fraud Prevention

Artists agree to cooperate fully with any investigation relating to:

  • payment disputes;
  • chargebacks;
  • suspected fraud;
  • unauthorised transactions;
  • identity verification;
  • policy breaches.

Where a chargeback occurs, Art is Lit may request evidence including:

  • proof of dispatch;
  • proof of delivery;
  • tracking information;
  • photographs of packaged Artwork;
  • communication with the Buyer.

Art is Lit reserves the right to:

  • suspend payouts during investigations;
  • recover funds where permitted by law or payment provider rules;
  • remove listings;
  • suspend or terminate Artist accounts involved in fraudulent activity.

Knowingly submitting false information or participating in fraudulent activity may result in permanent removal from the Platform.


26. Intellectual Property

Artists retain ownership of all intellectual property rights in their Artwork, branding, product photographs and other original content.

Nothing in these Artist Terms transfers ownership of an Artist’s intellectual property to Art is Lit.

Artists warrant that:

  • they own or have permission to use all uploaded content;
  • their listings do not infringe copyright, trademarks, design rights or other intellectual property rights;
  • they have obtained any necessary permissions from third parties.

Artists are solely responsible for any claims arising from their uploaded content.


27. Licence Granted to Art is Lit

By uploading content to the Platform, Artists grant Art is Lit a non-exclusive, worldwide, royalty-free licence to:

  • display Product Listings;
  • reproduce images and descriptions;
  • promote Artwork through advertising;
  • feature Artwork on the Platform;
  • use Artwork in newsletters;
  • share Artwork across social media;
  • use listing content in promotional campaigns relating to Art is Lit.

This licence exists solely for the purpose of operating, promoting and improving the Platform.

Artists retain ownership of their intellectual property at all times.

Upon removal of Artwork from the Platform, Art is Lit will cease using that content within a reasonable period, except where continued use is reasonably necessary for legal, administrative or archival purposes, or where the content forms part of completed transactions or previously published promotional materials.


28. Copyright Infringement

Artists warrant that their Artwork does not infringe the copyright or other intellectual property rights of any third party.

If Art is Lit receives a complaint alleging copyright infringement, we may:

  • temporarily remove the listing;
  • request evidence of ownership;
  • suspend payouts relating to the disputed Artwork;
  • investigate the complaint;
  • request further information from the Artist;
  • permanently remove infringing content;
  • suspend or terminate the Artist’s account where appropriate.

Artists who believe their content has been removed in error may submit evidence demonstrating ownership or lawful use of the material.

Repeated copyright infringement may result in permanent removal from the Platform.

Art is Lit reserves the right to cooperate with copyright owners, regulatory authorities and law enforcement agencies where required by law.


29. Prohibited Products and Activities

Artists must not list or sell products that:

  • infringe copyright or intellectual property rights;
  • are counterfeit or stolen;
  • falsely claim originality or authenticity;
  • contain unlawful or offensive material;
  • promote hatred, discrimination or violence;
  • are prohibited under applicable law;
  • breach sanctions or export restrictions.

Artists must not:

  • manipulate reviews or ratings;
  • create fake orders;
  • engage in fraudulent activity;
  • circumvent marketplace commission;
  • encourage Buyers to complete transactions outside the Platform;
  • upload malware or malicious software;
  • interfere with the security or operation of the Platform.

Art is Lit reserves the right to remove any listing that it reasonably believes breaches these Artist Terms or applicable law.


General Legal Provisions


30. Marketplace Standards

Art is Lit is committed to maintaining a professional, trustworthy and high-quality marketplace.

Artists are expected to conduct themselves in a manner that reflects positively on both their own business and the Art is Lit community.

Artists agree to:

  • maintain professional standards at all times;
  • communicate courteously with Buyers and Art is Lit;
  • comply with all Platform policies;
  • promptly resolve customer issues where reasonably possible;
  • maintain accurate Product Listings;
  • keep dispatch times up to date;
  • provide a positive buying experience.

Art is Lit reserves the right to curate the marketplace and may remove Artwork or suspend Artists where we reasonably believe that doing so is necessary to maintain the quality, reputation or integrity of the Platform.

Nothing in these Artist Terms guarantees that an Artist’s work will be displayed, promoted or featured in any particular manner.


31. Account Suspension and Termination

Art is Lit reserves the right to suspend, restrict or permanently terminate an Artist Account where we reasonably believe that the Artist has:

  • breached these Artist Terms or any other Platform policy;
  • provided false or misleading information;
  • repeatedly failed to fulfil customer orders;
  • sold counterfeit or stolen Artwork;
  • infringed copyright or other intellectual property rights;
  • uploaded misleading Product Listings;
  • engaged in fraudulent or unlawful activity;
  • abused the review system;
  • attempted to avoid marketplace commission by completing transactions outside the Platform;
  • acted in a manner that may damage the reputation, security or integrity of Art is Lit.

Where appropriate, Art is Lit may:

  • remove Product Listings;
  • suspend payouts;
  • restrict access to selling features;
  • require additional verification;
  • conduct investigations before making a final decision.

Termination of an Artist Account does not affect any rights or obligations arising before the date of termination, including obligations relating to completed orders, refunds or outstanding disputes.

Artists whose accounts have been terminated must not create a new Artist Account without the prior written permission of Art is Lit.


32. Indemnity

To the fullest extent permitted by law, Artists agree to indemnify, defend and hold harmless Art is Lit, its directors, employees, contractors, affiliates and service providers against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from or relating to:

  • any breach of these Artist Terms;
  • any breach of applicable laws or regulations;
  • the sale of the Artist’s products;
  • Product Listings;
  • infringement of copyright, trademarks or other intellectual property rights;
  • negligent, fraudulent or unlawful conduct;
  • disputes between the Artist and a Buyer;
  • taxes or financial obligations owed by the Artist.

This indemnity survives termination of the Artist Account.


33. Limitation of Liability

Art is Lit provides the Platform on an “as available” and “as is” basis.

To the fullest extent permitted by law, Art is Lit shall not be liable for:

  • loss of profits;
  • loss of income;
  • loss of business opportunities;
  • loss of reputation;
  • indirect, incidental or consequential losses;
  • payment provider failures;
  • courier delays;
  • customs delays;
  • internet outages;
  • cyberattacks;
  • actions or omissions of Buyers;
  • events beyond our reasonable control.

Art is Lit operates solely as a marketplace facilitator.

Artists acknowledge that they remain solely responsible for:

  • the products they sell;
  • customer service relating to their Artwork;
  • compliance with applicable laws;
  • tax obligations;
  • warranties provided to Buyers.

Nothing in these Artist Terms excludes or limits liability where such exclusion would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.


34. Force Majeure

Art is Lit shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control.

Such events include, but are not limited to:

  • natural disasters;
  • floods;
  • fires;
  • pandemics;
  • epidemics;
  • war;
  • terrorism;
  • civil unrest;
  • industrial disputes;
  • internet outages;
  • cyberattacks;
  • failures of third-party providers;
  • interruptions to payment services;
  • government action;
  • changes in law;
  • customs restrictions.

Where reasonably practicable, Art is Lit will take appropriate steps to minimise disruption to the Platform.


35. Privacy and Data Protection

Artists acknowledge that Art is Lit processes personal information in accordance with its Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Artists agree to:

  • provide accurate personal information;
  • keep their contact details up to date;
  • protect their account credentials;
  • comply with applicable privacy laws where they process Buyer information.

Artists must only use Buyer information for the purpose of fulfilling orders and providing customer service.

Buyer information must not be used for unsolicited marketing or shared with third parties unless required by law or expressly authorised by the Buyer.


36. Changes to these Artist Terms

Art is Lit may amend these Artist Terms from time to time to reflect changes in:

  • applicable laws;
  • marketplace functionality;
  • payment processes;
  • business operations;
  • security requirements;
  • Artist services.

Updated versions will be published on the Platform together with a revised “Last Updated” date.

Where changes are significant, Art is Lit will make reasonable efforts to notify registered Artists before the changes take effect.

Continued use of the Platform after updated Artist Terms become effective constitutes acceptance of those changes.

If an Artist does not agree with the revised Artist Terms, they must stop selling through the Platform and close their Artist Account.


37. Governing Law and Jurisdiction

These Artist Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Where mandatory consumer or commercial laws in another jurisdiction apply and cannot legally be excluded, those laws shall continue to apply to the extent required.

Any dispute arising between Art is Lit and an Artist relating to these Artist Terms shall, where permitted by law, be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Artist Terms limits any mandatory legal rights that cannot legally be excluded.


38. Entire Agreement

These Artist Terms, together with the:

  • Marketplace Terms & Conditions;
  • Privacy Policy;
  • Cookie Policy;
  • Shipping Policy;
  • Return & Refund Policy;
  • Artist Code of Conduct; and
  • any additional policies published by Art is Lit,

constitute the entire agreement between Art is Lit and the Artist regarding the Artist’s use of the Platform.

These documents replace and supersede all previous agreements, understandings, representations and communications relating to the Artist’s use of the Platform.

If any provision of these Artist Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by Art is Lit to enforce any provision of these Artist Terms shall not constitute a waiver of that provision or any other rights.

Acceptance of these Artist Terms

By applying to become an Artist, creating an Artist Account, listing Artwork for sale or continuing to sell through the Art is Lit Platform, you confirm that you have read, understood and agree to be legally bound by these Artist Terms & Conditions.
