These Terms & Conditions (“Terms”) govern your access to and use of the Art is Lit website, mobile applications (if available), services, and marketplace (collectively referred to as the “Platform”).
Art is Lit is an online marketplace that connects independent artists, makers, designers, photographers, galleries, creative businesses, and other approved Sellers with Buyers seeking original, handmade, limited edition, personalised, commissioned, and other creative works.
These Terms form a legally binding agreement between Art is Lit Ltd (“Art is Lit”, “we”, “us”, or “our”) and every person or organisation that accesses or uses the Platform, including:
- visitors browsing the Platform;
- registered Users;
- Buyers;
- Sellers;
- artists and creative businesses;
- galleries and organisations;
- and anyone who accesses or interacts with our services.
By accessing or using the Platform, creating an account, purchasing artwork, listing artwork for sale, communicating through the Platform, or using any of our services, you confirm that you:
- have read and understood these Terms;
- agree to be legally bound by them;
- will comply with all applicable laws and regulations; and
- accept our related policies, including our:
- Privacy Policy;
- Seller Agreement;
- Returns & Refunds Policy;
- Shipping Policy;
- Cookie Policy;
- Acceptable Use Policy;
- Copyright & Intellectual Property Policy; and
- any additional policies, guidelines, or notices published by Art is Lit from time to time.
If you do not agree to these Terms, you must not access or use the Platform.
Art is Lit reserves the right to amend these Terms from time to time to reflect changes in applicable law, technology, security, marketplace operations, payment systems, or our business practices.
Where we make material changes, we will publish the updated version on the Platform together with the revised “Last Updated” date and, where required by applicable law, take reasonable steps to notify affected Users before the changes take effect.
Your continued use of the Platform after updated Terms become effective constitutes your acceptance of those revised Terms.
Nothing in these Terms limits or excludes any statutory rights that cannot legally be excluded under applicable law.
2. Who We Are
Art is Lit Ltd (“Art is Lit”, “we”, “us”, or “our”) is an online marketplace dedicated to connecting independent artists and creative businesses with people who value original art, craftsmanship, and creativity.
Our mission is to create a trusted, inclusive, and inspiring platform where artists can showcase and sell their work with confidence, while Buyers can discover unique pieces directly from the people who create them.
Unlike traditional retailers, Art is Lit is a marketplace. Unless otherwise stated, each artwork is sold directly by an independent Seller, while Art is Lit provides the technology, payment infrastructure, customer support, and marketplace services that enable secure transactions between Buyers and Sellers.
We are committed to promoting creativity, supporting artists at every stage of their journey, and fostering a community built on authenticity, fairness, and respect.

3. Definitions
In these Terms & Conditions, unless the context requires otherwise, the following words and expressions have the meanings set out below.
Account means a registered User account created to access or use the Platform.
Artwork means any original, handmade, limited edition, open edition, personalised, commissioned, digital, or other creative work offered for sale or displayed on the Platform.
Art is Lit, we, us, or our means Art is Lit Ltd, a company registered in England and Wales.
Artist means an individual creator who produces Artwork and sells through the Platform. Unless the context requires otherwise, references to an Artist also include a Seller.
Buyer means any individual or organisation that purchases or attempts to purchase Artwork through the Platform.
Business Day means any day other than a Saturday, Sunday, or public holiday in England on which banks are generally open for business.
Commission means the marketplace fee charged by Art is Lit for completed sales in accordance with these Terms and the Seller Agreement.
Commissioned Artwork means Artwork created specifically to a Buyer’s individual requirements or specifications.
Content means all text, images, videos, graphics, audio, listings, reviews, logos, artwork, designs, software, and other material made available on or through the Platform.
Customer means any User who purchases, browses, enquires about, or otherwise interacts with the Platform as a Buyer.
Digital Download means any digital artwork, file, template, printable, photograph, illustration, or other downloadable content supplied electronically.
Dispute means any disagreement relating to an order, payment, delivery, return, refund, listing, intellectual property, or other matter arising through the Platform.
Force Majeure Event means any event beyond the reasonable control of a party, including natural disasters, war, terrorism, industrial action, pandemics, cyberattacks, or failures of utilities or communications.
Inspection Period means the 48-hour Buyer Inspection Period beginning when the shipping carrier confirms delivery of an order, during which a Buyer may inspect the Artwork and report a qualifying issue.
Intellectual Property Rights means all copyright, trade marks, patents, design rights, database rights, moral rights, trade secrets, domain names, and other intellectual property rights recognised under applicable law.
Listing means any advertisement, description, photograph, or information published by a Seller to offer Artwork for sale through the Platform.
Marketplace Commission means the standard commission charged by Art is Lit on completed sales, as set out in the Seller Agreement.
Order means a completed purchase transaction placed through the Platform.
Original Artwork means a unique, one-of-a-kind creative work produced by the Artist and not intended to be reproduced as an identical original.
Platform means the Art is Lit website, associated domains, mobile applications (where available), software, services, and any other online services operated by Art is Lit.
Privacy Policy means the Art is Lit Privacy Policy, as updated from time to time.
Prohibited Item means any product or content that may not be listed or sold through the Platform under these Terms, the Seller Agreement, or applicable law.
Seller means any individual, artist, gallery, collective, business, organisation, or other approved entity that lists or sells Artwork through the Platform.
Seller Agreement means the legally binding agreement between Art is Lit and each approved Seller governing the sale of Artwork through the Platform.
Services means all marketplace services, features, tools, payment processing, communications, customer support, and other functionality provided by Art is Lit.
Terms means these Terms & Conditions, together with any amendments published by Art is Lit from time to time.
User means any individual or organisation that accesses or uses the Platform, whether or not they create an Account.
Verification means any identity, business, payment, security, or compliance checks carried out by or on behalf of Art is Lit.
Words importing the singular include the plural and vice versa. References to one gender include all genders. References to a person include individuals, companies, partnerships, charities, public bodies, and other legal entities where the context permits.
Headings are included for convenience only and do not affect the interpretation of these Terms.
4. The Art is Lit Marketplace
Art is Lit is an online marketplace that connects Buyers with independent Sellers who offer original, handmade, limited edition, personalised, commissioned, digital, and other creative works for sale.
Our Platform is designed to provide a trusted environment where creativity can flourish, enabling independent artists and creative businesses to showcase their work while giving Buyers access to unique artwork from around the world.
4.1 Our Role
Art is Lit provides and operates the Platform and related marketplace services, including, where applicable:
- providing access to the online marketplace;
- enabling Buyers and Sellers to connect and communicate through the Platform;
- facilitating secure payment processing through approved payment providers;
- holding payments during the Buyer Inspection Period where applicable;
- providing customer support and marketplace assistance;
- administering dispute resolution in accordance with our policies;
- maintaining marketplace standards and community guidelines;
- verifying Sellers where appropriate;
- promoting the Platform and its Sellers; and
- continually improving the services we provide.
Our role is to facilitate transactions between Buyers and independent Sellers. Unless expressly stated otherwise, Art is Lit is not the manufacturer, creator, owner, importer, exporter, reseller, or supplier of the Artwork offered for sale on the Platform.
4.2 Independent Sellers
Each Seller is an independent individual or business and is responsible for:
- creating and managing their listings;
- accurately describing their Artwork;
- setting their own prices;
- ensuring they have the legal right to sell the Artwork;
- complying with applicable laws and regulations;
- packaging and dispatching orders;
- providing accurate information to Buyers; and
- fulfilling their obligations under the Seller Agreement and applicable law.
The contract for the sale of Artwork is generally formed directly between the Buyer and the Seller. Art is Lit is not a party to that sales contract unless expressly stated otherwise.
4.3 Marketplace Services
To help create a safe and trusted marketplace, Art is Lit may:
- verify information provided by Users;
- monitor activity on the Platform;
- review listings for compliance with our policies;
- investigate suspected fraud or policy breaches;
- suspend or remove listings;
- temporarily hold payments where appropriate;
- restrict or suspend Accounts;
- remove content that breaches our policies or applicable law; and
- take any other reasonable action necessary to protect Buyers, Sellers, the Platform, or the wider community.
These actions are intended to maintain the integrity, security, and reputation of the Art is Lit marketplace.
4.4 No Guarantee of Sales or Availability
Art is Lit does not guarantee that:
- any Artwork will be sold;
- any listing will receive views or enquiries;
- any Seller will achieve a particular level of sales or income;
- any Buyer will complete a purchase;
- any Artwork will remain available for purchase; or
- the Platform will always be available without interruption.
Marketplace activity depends on many factors beyond our reasonable control.
4.5 Marketplace Integrity
We are committed to maintaining a fair, inclusive, and professional marketplace.
To protect the interests of Buyers, Sellers, and the wider Art is Lit community, we may introduce new features, modify marketplace processes, improve security measures, or update our policies where reasonably necessary.
Where material changes affect Users’ rights or obligations, we will provide notice in accordance with these Terms and applicable law.
4.6 Compliance with Applicable Law
Nothing in these Terms limits any legal responsibilities that Art is Lit may have under applicable laws relating to consumer protection, payment services, data protection, or other legal obligations.
Similarly, nothing in these Terms removes the legal responsibilities of Buyers or Sellers under applicable law.
Art is Lit seeks to operate its marketplace fairly, transparently, and in compliance with the laws of England and Wales, while respecting mandatory legal rights that apply in other jurisdictions where the Platform is available.
5. Eligibility to Use the Platform
To help maintain a safe, secure, and trusted marketplace, all Users must meet the eligibility requirements set out in these Terms before accessing certain features of the Platform or creating an Account.
By accessing or using the Platform, you confirm that you satisfy the requirements set out below.
5.1 Minimum Age
You must be at least 18 years old, or the age of legal majority in your country of residence (whichever is higher), to create an Account, purchase Artwork, register as a Seller, or enter into legally binding agreements through the Platform.
If you are under the required age, you may only use the Platform under the direct supervision of a parent or legal guardian and may not create an Account or make purchases in your own name unless permitted by applicable law.
5.2 Legal Capacity
By using the Platform, you confirm that you:
- have the legal capacity to enter into a binding contract;
- are not prohibited from using our services under any applicable law;
- will comply with these Terms and all applicable laws and regulations; and
- will provide accurate and truthful information when requested.
5.3 Individuals and Businesses
The Platform may be used by:
- private individuals;
- sole traders;
- partnerships;
- companies;
- charities;
- galleries;
- creative organisations; and
- other legally recognised entities approved by Art is Lit.
If you create or operate an Account on behalf of a business or organisation, you confirm that you have the authority to bind that organisation to these Terms.
5.4 Restricted Persons and Jurisdictions
You must not use the Platform if:
- you are subject to sanctions, trade restrictions, or export controls that prohibit your use of our services;
- applicable law prevents you from entering into transactions through the Platform;
- you intend to use the Platform for unlawful, fraudulent, or deceptive purposes; or
- your use of the Platform would cause Art is Lit or its service providers to breach applicable laws or regulations.
Art is Lit reserves the right to restrict or refuse access to the Platform where necessary to comply with legal or regulatory obligations.
5.5 Accurate Information
Users must provide information that is accurate, complete, and up to date.
You agree to promptly update your Account details if your information changes, including your:
- name;
- contact details;
- billing information;
- delivery address;
- business information (where applicable); and
- any other information required to maintain your Account.
Providing false, misleading, or incomplete information may result in restrictions on your Account, delayed payments, suspension, or termination.
5.6 Verification
Art is Lit may require Users to complete identity, business, payment, security, or compliance checks before granting access to certain features of the Platform.
Where verification is requested, Users agree to provide accurate information and any documentation reasonably required to verify their identity or eligibility.
Failure to complete requested verification may limit access to certain services, delay transactions or payouts, or result in the suspension or closure of an Account.
5.7 One Account Per User
Unless expressly authorised by Art is Lit, each User may maintain only one personal Account and, where applicable, one Seller Account.
Creating multiple Accounts to avoid restrictions, manipulate reviews, abuse promotions, or otherwise circumvent these Terms is prohibited.
5.8 Our Right to Refuse Access
Art is Lit reserves the right to refuse, suspend, restrict, or terminate access to the Platform where we reasonably believe that:
- a User does not meet the eligibility requirements;
- false or misleading information has been provided;
- there has been a breach of these Terms or any related policy;
- verification requirements have not been satisfied;
- fraud or unlawful activity is suspected; or
- continued access may expose Art is Lit, its Users, or third parties to legal, financial, operational, or security risks.
Where appropriate and legally permitted, we will explain the reason for our decision. However, there may be circumstances where we are unable to disclose specific details, including where doing so could compromise security measures, ongoing investigations, legal proceedings, or our obligations under applicable law.
5.9 Compliance with Applicable Law
Users remain responsible for ensuring that their use of the Platform complies with all laws and regulations applicable in the country or region from which they access or use the Platform.
Nothing in these Terms obliges Art is Lit to make the Platform available in any particular country or jurisdiction.
6. User Accounts
To access certain features of the Platform, including purchasing Artwork, selling through the marketplace, saving favourites, leaving reviews, or communicating through the Platform, Users may be required to create an Account.
By creating or using an Account, you agree to comply with these Terms and to keep your Account secure and up to date.
6.1 Creating an Account
When registering for an Account, you must provide accurate, complete, and current information.
You agree that all information provided during registration, and throughout your use of the Platform, will be truthful and not misleading.
Art is Lit reserves the right to refuse any Account registration or request additional information before activating an Account.
6.2 Account Types
Depending on how you use the Platform, you may register as:
- a Buyer;
- a Seller (subject to approval and the Seller Agreement); or
- another type of Account that Art is Lit may introduce from time to time.
Some features may only be available to approved Sellers or verified Users.
6.3 Account Security
You are responsible for maintaining the confidentiality and security of your login credentials, including your password.
You agree to:
- choose a strong and unique password;
- keep your login credentials confidential;
- not share your Account with another person unless expressly authorised by Art is Lit;
- log out of your Account when using shared or public devices; and
- notify Art is Lit immediately if you believe your Account has been accessed without your permission.
You are responsible for all activity carried out through your Account unless you can demonstrate that the activity resulted from a security failure for which you were not responsible.
6.4 Keeping Your Information Up to Date
You must ensure that your Account information remains accurate and current.
This includes updating your:
- name;
- email address;
- telephone number;
- delivery and billing addresses;
- payment information;
- business details (where applicable); and
- any other information necessary for the operation of your Account.
Failure to keep your information up to date may affect our ability to provide services, process orders, verify your identity, or contact you.
6.5 Unauthorised Access
If you suspect that your Account has been compromised, you must notify Art is Lit as soon as reasonably possible using support@artislit.com.
Art is Lit may temporarily suspend access to your Account where reasonably necessary to protect you, other Users, or the Platform while the matter is investigated.
6.6 Social Login
Where available, Users may register or sign in using approved third-party authentication providers, such as Google or Facebook.
By choosing to use a social login service, you authorise Art is Lit to receive the information necessary to authenticate your Account in accordance with our Privacy Policy.
Your use of any third-party authentication service is also subject to that provider’s own terms and privacy policy.
6.7 Account Ownership
Each Account is personal to the registered User or authorised business.
You may not:
- sell or transfer your Account to another person;
- allow another person to impersonate you;
- create an Account using another person’s identity without lawful authority; or
- create an Account on behalf of another person without their authorisation.
Art is Lit reserves the right to request proof of identity or authority where ownership of an Account is disputed.
6.8 Suspension and Closure
Art is Lit may suspend, restrict, or close an Account where reasonably necessary, including where:
- these Terms have been breached;
- false or misleading information has been provided;
- fraud or unlawful activity is suspected;
- verification requirements have not been been completed;
- the security of the Platform or other Users may be at risk; or
- we are required to do so by law or a competent authority.
Where appropriate and legally permitted, we will explain the reason for our decision.
6.9 Closing Your Account
You may request the closure of your Account at any time by following the procedures available through the Platform or by contacting support@artislit.com.
Closing an Account does not affect:
- any outstanding orders;
- ongoing disputes;
- payment obligations;
- refund requests;
- legal claims;
- fraud investigations; or
- any obligations that are intended to continue after an Account has been closed.
Certain information may be retained where required by law, for fraud prevention, accounting, dispute resolution, or other legitimate business purposes, as explained in our Privacy Policy.
6.10 Future Security Measures
To help protect the Platform, Art is Lit may introduce additional security measures from time to time, including:
- two-factor authentication (2FA);
- device verification;
- login notifications;
- identity verification;
- biometric authentication where supported; or
- other security technologies.
Where such measures become mandatory for certain Users or Account types, reasonable notice will be provided where practicable.
6.11 Our Commitment
Art is Lit is committed to maintaining a secure, reliable, and trustworthy marketplace.
While we implement reasonable technical and organisational measures to protect User Accounts, no online platform can guarantee absolute security.
Users also play an essential role in protecting their Accounts by following good security practices and promptly reporting any suspected unauthorised activity.
7. Buyer Accounts
Art is Lit is committed to providing Buyers with a secure, transparent, and enjoyable marketplace where they can discover and purchase original artwork directly from independent Sellers.
By creating a Buyer Account or placing an order through the Platform, you agree to comply with these Terms and all applicable policies published by Art is Lit.
7.1 Creating a Buyer Account
A Buyer Account may be created to access additional features of the Platform, including:
- purchasing Artwork;
- saving favourite artworks or Sellers;
- tracking orders;
- managing delivery information;
- communicating with Sellers through the Platform;
- submitting reviews where eligible; and
- accessing order history and other account features.
Some areas of the Platform may be available without creating an Account.
7.2 Buyer Responsibilities
Buyers agree to:
- provide accurate and up-to-date information;
- place orders in good faith;
- pay for purchases using authorised payment methods;
- comply with these Terms and applicable laws;
- communicate respectfully with Sellers and Art is Lit;
- inspect orders within the applicable Buyer Inspection Period; and
- cooperate with any investigation relating to an order, return, refund, or dispute.
7.3 Purchasing Artwork
Before placing an order, Buyers should carefully review:
- the artwork description;
- photographs;
- dimensions;
- materials used;
- edition details where applicable;
- estimated dispatch and delivery times;
- shipping restrictions; and
- any other information provided in the listing.
By completing a purchase, the Buyer confirms that they have reviewed the listing and understand the nature of the Artwork being purchased.
7.4 Buyer Protection
To help create confidence when purchasing through the Platform, eligible orders benefit from the protections described in our Returns & Refunds Policy, including the 48-hour Buyer Inspection Period, during which qualifying issues may be reported.
Buyer protection is subject to compliance with these Terms, our Returns & Refunds Policy, and any applicable law.
7.5 Communication with Sellers
Buyers are encouraged to communicate with Sellers through the messaging features provided by the Platform where available.
Keeping communications within the Platform helps:
- protect both parties;
- provide a record of discussions;
- assist with dispute resolution if required; and
- improve customer support.
Buyers should not use Platform messaging to send abusive, unlawful, fraudulent, or inappropriate content.
7.6 Reviews
Eligible Buyers may be invited to leave reviews relating to their purchasing experience.
Reviews should:
- be honest and based on genuine experience;
- be respectful and constructive;
- not contain offensive, defamatory, discriminatory, or unlawful content;
- not include confidential or personal information about another person; and
- comply with our Community Guidelines.
Art is Lit reserves the right to remove reviews that breach these Terms or applicable law.
7.7 Buyer Conduct
Buyers must not:
- submit fraudulent orders;
- abuse the returns or dispute process;
- attempt to obtain refunds dishonestly;
- harass, threaten, or intimidate Sellers or other Users;
- misuse promotional offers or discount codes;
- interfere with the operation or security of the Platform; or
- engage in any unlawful, deceptive, or unfair conduct.
7.8 Our Commitment to Buyers
Art is Lit is committed to creating a marketplace built on trust, fairness, and transparency.
We aim to:
- support Buyers throughout their purchasing journey;
- encourage high standards among Sellers;
- investigate genuine concerns fairly and impartially;
- provide clear policies and guidance; and
- continually improve the services and protections available through the Platform.
While we cannot guarantee that every transaction will be free from issues, we are committed to working with Buyers and Sellers to achieve fair and reasonable outcomes in accordance with our policies and applicable law.
8. Seller Accounts
Art is Lit is committed to building a trusted marketplace that showcases high-quality artwork created by talented independent artists and creative businesses.
To help maintain the integrity, quality, and reputation of the Platform, all Seller Accounts are subject to an approval process and ongoing compliance with these Terms, the Seller Agreement, and our related policies.
8.1 Becoming a Seller
To sell through the Platform, a User must first register for a Seller Account and complete any onboarding requirements specified by Art is Lit.
Submitting an application does not guarantee approval.
Art is Lit reserves the right to approve or decline Seller applications at its discretion, acting reasonably and in accordance with applicable law.
8.2 Seller Eligibility
To become a Seller, you must:
- meet the eligibility requirements set out in these Terms;
- provide accurate and complete registration information;
- accept the Seller Agreement;
- provide any verification information reasonably requested by Art is Lit;
- have the legal right to sell the Artwork you list; and
- comply with all applicable laws and regulations.
Where a Seller operates as a business, the person creating the Seller Account confirms that they have the authority to act on behalf of that business.
8.3 Seller Verification
To help protect Buyers and maintain marketplace standards, Art is Lit may require Sellers to complete identity, business, payment, tax, or other verification checks before or after approval.
Verification requirements may include:
- proof of identity;
- proof of address;
- business registration details where applicable;
- bank account verification;
- tax information;
- payment verification; or
- any other information reasonably required to comply with legal, regulatory, fraud prevention, or security obligations.
Art is Lit may request updated verification information from time to time.
8.4 Seller Profiles
Approved Sellers may create a public profile that may include:
- a profile photograph or logo;
- a biography;
- links to social media accounts where supported;
- portfolio information;
- shop policies;
- location (where chosen by the Seller);
- and other information made available through the Platform.
Sellers are responsible for ensuring that all information displayed on their profile is accurate, lawful, and kept up to date.
8.5 Seller Dashboard
Approved Sellers may access a Seller Dashboard providing tools to manage their business through the Platform.
Features may include:
- creating and editing listings;
- managing orders;
- tracking payments and payouts;
- responding to customer enquiries;
- managing shipping settings;
- viewing performance information; and
- accessing marketplace resources and support.
Art is Lit may introduce, remove, or modify dashboard features from time to time as the Platform evolves.
8.6 Ongoing Responsibilities
Approval as a Seller is an ongoing privilege rather than a permanent entitlement.
Sellers are expected to:
- maintain high standards of customer service;
- provide accurate listings;
- dispatch orders within stated processing times;
- respond to customer enquiries promptly;
- comply with the Seller Agreement;
- cooperate during investigations and disputes; and
- maintain the quality and reputation of the Art is Lit marketplace.
Failure to meet these standards may result in corrective action.
8.7 Seller Performance
Art is Lit may monitor Seller performance to help maintain a high-quality marketplace.
Factors that may be considered include:
- customer reviews;
- order fulfilment;
- dispatch times;
- cancellation rates;
- dispute history;
- communication with Buyers;
- compliance with marketplace policies; and
- overall account standing.
Where concerns arise, Art is Lit may provide guidance, request improvements, temporarily restrict certain features, or take other reasonable action to protect the marketplace.
8.8 Suspension or Removal of Seller Status
Art is Lit may suspend, restrict, or remove Seller privileges where reasonably necessary, including where a Seller:
- breaches these Terms or the Seller Agreement;
- repeatedly fails to meet marketplace standards;
- provides false or misleading information;
- engages in fraudulent, unlawful, or deceptive conduct;
- infringes intellectual property rights;
- fails required verification checks; or
- creates legal, financial, operational, or reputational risks for the Platform.
Where appropriate and legally permitted, Art is Lit will explain the reason for its decision and, where appropriate, provide the Seller with an opportunity to respond or remedy the issue.
8.9 Our Commitment to Sellers
Art is Lit values the creativity, originality, and professionalism of the artists and creative businesses who choose to sell through our Platform.
We are committed to:
- providing a fair and transparent marketplace;
- supporting Sellers through clear policies and guidance;
- promoting creativity and independent artists;
- continually improving the tools and services available to Sellers; and
- fostering a respectful community where Buyers and Sellers can trade with confidence.
We believe that maintaining high standards benefits everyone and helps ensure the long-term success of the Art is Lit marketplace.
9. Identity Verification (Know Your Customer – KYC)
To help protect Buyers, Sellers, and the integrity of the Art is Lit Platform, we may require identity, business, payment, or other verification before granting access to certain services or features.
Identity verification helps reduce fraud, prevent unauthorised activity, comply with legal and regulatory obligations, and maintain a trusted marketplace for everyone.
Authentication methods, including signing in with Google, Facebook, or other approved third-party providers, are designed to simplify account access. However, authentication does not replace any identity verification requirements that may apply under these Terms or the Seller Agreement.
9.1 When Verification May Be Required
Art is Lit may require verification before, during, or after a User creates an Account or carries out certain activities on the Platform.
Verification may be required to:
- register or continue operating as a Seller;
- receive payouts or other payments;
- process higher-value transactions;
- verify the identity of Users where additional checks are reasonably required;
- investigate suspected fraud or suspicious activity;
- comply with applicable laws, regulations, court orders, or requests from competent authorities;
- satisfy the requirements of payment providers or financial institutions;
- maintain the security and integrity of the Platform; or
- protect Buyers, Sellers, and Art is Lit from fraud or other unlawful activity.
Verification requirements may change from time to time to reflect legal, regulatory, operational, or security developments.
9.2 Information We May Request
Depending on the type of Account and the services being used, Art is Lit may request information including:
- proof of identity (such as a passport or driving licence);
- proof of address;
- date of birth;
- business registration details;
- company registration number (where applicable);
- VAT or tax identification numbers (where applicable);
- bank account details for payouts;
- payment verification;
- contact information; and
- any other information reasonably required to verify identity, ownership, eligibility, or compliance with applicable law.
We will only request information that is reasonably necessary for the relevant verification purpose.
9.3 Third-Party Authentication
Art is Lit may allow Users to register or sign in using approved third-party authentication providers, including Google, Facebook, or other authentication services that we may introduce in the future.
By choosing this method, you authorise Art is Lit to receive the information necessary to create, authenticate, and manage your Account in accordance with our Privacy Policy.
The information we receive depends on the permissions you grant and the information shared by the authentication provider. This may include your name, email address, profile picture, and a unique authentication identifier.
Your use of any third-party authentication provider remains subject to that provider’s own terms of service and privacy policy.
Using a third-party authentication provider does not, by itself, satisfy any identity verification requirements that may apply under these Terms, the Seller Agreement, or applicable law.
9.4 Third-Party Verification Providers
Art is Lit may use trusted third-party providers to assist with:
- identity verification;
- payment verification;
- fraud prevention;
- sanctions screening;
- anti-money laundering checks where applicable;
- regulatory compliance; and
- other security or verification services.
By using the Platform, you acknowledge that information provided for verification may be securely shared with these providers for the purposes described in our Privacy Policy.
Any third-party provider engaged by Art is Lit is expected to process Personal Information in accordance with applicable data protection legislation.
9.5 Accuracy of Information
Users must ensure that all information provided for verification is:
- accurate;
- complete;
- current; and
- not misleading.
Providing false, forged, incomplete, or misleading information may result in:
- delayed approval;
- delayed payouts;
- suspension of listings;
- temporary restriction of Platform features;
- suspension or termination of an Account; or
- any other action reasonably necessary to protect the Platform or comply with applicable law.
9.6 Ongoing Verification
Art is Lit may request updated verification information where:
- Account details change;
- verification documents expire;
- legal or regulatory requirements change;
- suspicious activity is detected;
- payment providers require additional checks;
- ownership of an Account is questioned; or
- further verification is reasonably necessary.
Failure to complete requested verification may restrict access to certain Platform features or delay transactions or payouts.
9.7 Refusal or Failure to Verify
Where a User refuses or fails to complete required verification, Art is Lit may:
- refuse a Seller application;
- delay or withhold payouts where permitted by law;
- restrict Account functionality;
- suspend or terminate an Account; or
- refuse access to certain services until verification has been successfully completed.
Where appropriate and legally permitted, we will explain the reason for our decision.
9.8 Fraud Prevention and Security
Art is Lit is committed to protecting the Platform against fraud and other unlawful activity.
We may monitor transactions, Account activity, payment information, login activity, device information, and other relevant information to help identify:
- fraudulent transactions;
- identity theft;
- unauthorised access;
- payment fraud;
- account takeover attempts;
- money laundering;
- sanctions breaches;
- intellectual property abuse; or
- other unlawful or suspicious activity.
Where appropriate, we may cooperate with payment providers, financial institutions, regulatory authorities, and law enforcement agencies in accordance with applicable law.
9.9 Data Protection
Verification information will be collected, processed, stored, and protected in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We implement appropriate technical and organisational measures to protect verification information against unauthorised access, loss, misuse, alteration, or disclosure.
9.10 Our Commitment
Identity verification is an important part of maintaining a secure and trusted marketplace.
By helping confirm the identity of Buyers and Sellers, reducing fraud, and supporting compliance with legal obligations, verification contributes to a safer experience for everyone using the Art is Lit Platform.
Art is Lit will always seek to balance security, privacy, fairness, and user experience when designing and operating its verification processes.
10. Product Listings
Product listings are the primary way Sellers present Artwork to Buyers through the Art is Lit Platform.
To maintain a trusted, professional, and high-quality marketplace, all listings must be accurate, complete, lawful, and comply with these Terms, the Seller Agreement, and any other policies published by Art is Lit.
10.1 Seller Responsibility
Sellers are solely responsible for the content of their listings.
By publishing a listing, the Seller confirms that:
- they have the legal right to sell the Artwork;
- all information provided is accurate, complete, and not misleading;
- the listing complies with applicable laws and regulations;
- the Artwork does not infringe the intellectual property rights of any third party;
- all photographs and descriptions accurately represent the Artwork being offered; and
- they will keep the listing up to date while it remains available for sale.
10.2 Listing Information
Each listing should include, where applicable:
- the title of the Artwork;
- a clear and accurate description;
- dimensions;
- materials used;
- medium;
- colour information where relevant;
- framing details;
- edition information (if applicable);
- whether the Artwork is original, handmade, limited edition, open edition, print, digital download, or commissioned work;
- care instructions where appropriate;
- dispatch or production times;
- shipping restrictions (if any); and
- any other information that may reasonably assist a Buyer in making an informed purchasing decision.
Sellers must not omit information that could materially affect a Buyer’s decision to purchase.
10.3 Photographs
Photographs must accurately represent the Artwork being offered.
Images should:
- be clear and of good quality;
- show the Artwork from appropriate angles;
- accurately represent colours as closely as reasonably possible;
- not contain misleading digital alterations;
- not include watermarks that obscure the Artwork; and
- belong to the Seller or be used with appropriate permission.
Lifestyle images may be used provided they do not mislead Buyers about the size, colour, condition, or appearance of the Artwork.
10.4 Pricing
Sellers are responsible for setting their own prices.
Prices must:
- be accurate;
- include any information required by applicable law;
- not be misleading;
- not be manipulated through deceptive practices; and
- remain consistent with the information presented in the listing.
Art is Lit reserves the right to remove or suspend listings that contain obvious pricing errors or appear to be fraudulent.
10.5 Availability
Sellers must ensure that listed Artwork remains available for purchase while the listing is active.
If an Artwork becomes unavailable, has already been sold elsewhere, or can no longer be supplied, the Seller must update or remove the listing without unnecessary delay.
10.6 Listing Standards
All listings should reflect the professional standards expected of the Art is Lit marketplace.
Listings must not:
- contain false or misleading statements;
- include offensive, discriminatory, hateful, or unlawful content;
- promote illegal activities;
- infringe copyright, trade marks, or other intellectual property rights;
- include spam, malicious links, or deceptive content;
- impersonate another artist, business, or organisation; or
- otherwise damage the reputation or integrity of the Platform.
10.7 Curated Marketplace
Art is Lit aims to provide Buyers with a carefully curated marketplace that celebrates creativity, originality, craftsmanship, and artistic excellence.
To help maintain these standards, Art is Lit reserves the right to review, refuse, edit (with the Seller’s agreement where appropriate), suspend, or remove any listing that:
- does not comply with these Terms or the Seller Agreement;
- contains inaccurate or misleading information;
- infringes intellectual property rights;
- presents an unacceptable legal, reputational, or operational risk;
- does not meet the quality standards expected of the Platform; or
- is otherwise considered unsuitable for the Art is Lit marketplace.
Art is Lit’s decision to approve, decline, or remove a listing will be made reasonably and in accordance with applicable law.
10.8 Changes to Listings
Sellers may update their listings at any time, provided the changes remain accurate and comply with these Terms.
Changes made after an order has been placed will not affect that order unless agreed by the Buyer or otherwise required by law.
10.9 Monitoring
Art is Lit may monitor listings to help maintain marketplace standards and ensure compliance with these Terms.
Monitoring may include automated systems, manual reviews, customer reports, or other reasonable methods.
Monitoring does not mean that Art is Lit approves, guarantees, or endorses every listing published on the Platform.
10.10 Removal of Listings
Art is Lit may remove, suspend, or restrict any listing where we reasonably believe that it:
- breaches these Terms or the Seller Agreement;
- infringes intellectual property rights;
- is fraudulent or misleading;
- contains prohibited content;
- creates a legal, security, or reputational risk;
- has become unavailable; or
- is required to be removed under applicable law or by a competent authority.
Where appropriate and legally permitted, we will explain the reason for our decision and, where appropriate, give the Seller an opportunity to correct the issue before permanent removal.
10.11 Our Commitment
Art is Lit is committed to maintaining a marketplace where Buyers can purchase with confidence and Sellers can showcase their creativity in a professional environment.
By encouraging accurate listings, honest descriptions, and high-quality presentation, we aim to create a marketplace built on trust, transparency, originality, and respect for both artists and customers.
11. Pricing, Marketplace Commission and Fees
Art is Lit is committed to providing a transparent pricing structure that allows Sellers to retain control over the prices they set while enabling the Platform to operate as a sustainable marketplace.
Unless otherwise stated, Sellers determine the selling price of their Artwork, subject to these Terms, the Seller Agreement, and applicable law.
11.1 Seller Pricing
Sellers are responsible for setting the prices of their Artwork.
Prices must:
- be accurate and not misleading;
- comply with all applicable laws and regulations;
- reflect the total selling price displayed to Buyers;
- accurately describe what is included in the purchase; and
- remain current while the listing is active.
Sellers are responsible for correcting any pricing errors as soon as reasonably possible.
11.2 Marketplace Commission
Art is Lit currently charges a standard marketplace commission of fifteen per cent (15%) on each completed sale unless otherwise agreed in writing.
The commission is deducted before the Seller’s payout is processed.
The commission helps support the operation and continued development of the Platform, including:
- maintaining the online marketplace;
- secure payment processing;
- buyer protection features;
- customer support;
- fraud prevention;
- dispute resolution;
- platform maintenance;
- security enhancements;
- marketing and promotion of the marketplace; and
- ongoing improvements to our services.
11.3 Promotional Commission Rates
From time to time, Art is Lit may offer promotional commission rates to selected Sellers or as part of marketplace promotions.
Unless expressly stated otherwise in the promotion:
- promotional commission rates apply only for the advertised promotional period;
- the standard marketplace commission of 15% will automatically apply once the promotion ends;
- promotional rates cannot be combined with other commission offers unless expressly agreed by Art is Lit; and
- Art is Lit reserves the right to withdraw, amend, or extend promotional offers in accordance with their published terms.
Participation in a promotional offer does not create a permanent right to a reduced commission rate.
11.4 Other Fees
Art is Lit does not currently charge listing fees or subscription fees unless expressly stated on the Platform.
If additional optional services become available in the future, such as promoted listings, advertising, premium subscriptions, or enhanced seller tools, any applicable fees will be clearly explained before a Seller chooses to use those services.
No optional fee will be charged without the Seller’s knowledge and agreement.
11.5 Taxes
Sellers remain responsible for:
- determining whether they are required to register for VAT or other taxes;
- collecting, reporting, and paying any taxes for which they are legally responsible;
- complying with tax obligations in the countries where they operate; and
- maintaining any records required by applicable law.
Art is Lit may collect, report, or remit taxes where required by law or where required by payment providers.
11.6 Pricing Errors
Where an obvious pricing error has occurred due to a technical issue, typographical mistake, or other genuine error, Art is Lit reserves the right to suspend or cancel the affected transaction before dispatch, acting reasonably and in accordance with applicable law.
Where possible, the Buyer and Seller will be notified promptly, and any payment already received will be refunded using the original payment method.
11.7 Currency
The Platform may display prices in different currencies for convenience.
Unless otherwise stated, payments will be processed in the currency displayed at checkout.
Exchange rates are determined by payment providers or financial institutions and may vary over time.
Art is Lit is not responsible for exchange rate fluctuations or fees charged by banks, card issuers, or payment providers.
11.8 Changes to Commission or Fees
Art is Lit may review and update its commission structure or introduce new optional services from time to time.
Where changes materially affect Sellers, we will provide reasonable notice before the changes take effect, unless immediate changes are required by law or for security reasons.
Updated commission rates or fees will be published on the Platform and, where applicable, reflected in the Seller Agreement.
11.9 Transparency
Art is Lit is committed to maintaining a fair and transparent marketplace.
We will clearly communicate our commission structure, any applicable fees, and any material changes that affect Buyers or Sellers.
Our aim is to ensure that Sellers understand how fees are calculated and Buyers can purchase with confidence, knowing that pricing is presented honestly and transparently.
12. Payments and Payouts
Art is Lit facilitates payments between Buyers and Sellers using approved third-party payment providers.
To help protect Buyers and Sellers, payments may be temporarily held before being released to the Seller in accordance with these Terms, the Seller Agreement, and our Returns & Refunds Policy.
12.1 Payment Processing
All payments made through the Platform are processed securely by approved third-party payment providers.
Art is Lit does not store complete payment card details.
By purchasing or selling through the Platform, Users agree to comply with the terms and conditions of the relevant payment provider.
12.2 Accepted Payment Methods
The payment methods available may vary depending on the Buyer’s location and the payment providers supported by the Platform.
Art is Lit may add, remove, or change supported payment methods from time to time.
12.3 Payment Authorisation
By placing an order, the Buyer authorises the relevant payment provider to charge the selected payment method for:
- the purchase price of the Artwork;
- applicable delivery charges;
- taxes or duties collected at checkout where applicable; and
- any other charges clearly disclosed before payment is completed.
12.4 Buyer Inspection Period
Following confirmation by the shipping carrier that an order has been delivered, a 48-hour Buyer Inspection Period begins.
During this period:
- payment will normally remain on hold;
- the Buyer may inspect the Artwork;
- qualifying issues may be reported in accordance with the Returns & Refunds Policy; and
- payment will not normally be released to the Seller until the inspection period has ended or the Buyer accepts the order earlier.
12.5 Release of Seller Payouts
Where no qualifying issue has been reported during the Buyer Inspection Period, the order will normally be treated as accepted.
Following acceptance, Seller payouts will normally be released three (3) days after the end of the Buyer Inspection Period, subject to:
- successful payment processing;
- completion of any required verification;
- no active disputes or chargebacks;
- compliance with these Terms and the Seller Agreement; and
- any reasonable fraud prevention or security checks.
Payment providers and banking institutions may require additional processing time before funds appear in the Seller’s account.
12.6 Payment Holds
Art is Lit may temporarily delay or hold payments where reasonably necessary, including where:
- a dispute has been opened;
- fraud is suspected;
- verification requirements remain outstanding;
- a chargeback has been initiated;
- a payment is under review by the payment provider;
- there is evidence of a breach of these Terms or the Seller Agreement;
- we are required to do so by law; or
- another legitimate security or compliance concern arises.
Where appropriate and legally permitted, we will inform the affected User of any significant payment delay.
12.7 Refunds
Where a refund is approved under our Returns & Refunds Policy, Art is Lit may:
- refund the Buyer using the original payment method;
- adjust Seller payouts where appropriate;
- recover amounts previously paid where permitted by law and the Seller Agreement; or
- take any other reasonable action necessary to give effect to the approved refund.
12.8 Chargebacks and Payment Disputes
If a Buyer disputes a payment with their bank or payment provider, Art is Lit may:
- suspend the associated payout;
- investigate the transaction;
- request information from the Buyer and Seller;
- provide relevant information to the payment provider; and
- recover funds where permitted by law or under the Seller Agreement.
Users agree to cooperate with any reasonable request for information relating to a payment dispute.
12.9 Failed Payments
If a payment cannot be successfully authorised or processed:
- the order will not normally be completed;
- the Seller will not be required to dispatch the Artwork;
- Art is Lit may cancel the transaction; and
- the Buyer may be invited to use an alternative payment method.
12.10 Payment Provider Delays
Art is Lit is not responsible for delays caused solely by:
- banks;
- card issuers;
- payment providers;
- currency conversion services; or
- other financial institutions involved in processing payments.
However, we will make reasonable efforts to assist Users in resolving payment-related issues where appropriate.
12.11 Financial Compliance
Art is Lit reserves the right to take any action reasonably necessary to comply with applicable financial, regulatory, anti-fraud, anti-money laundering, sanctions, or payment services requirements.
This may include delaying, restricting, refusing, or reversing transactions where required or permitted by applicable law.
12.12 Transparency
Art is Lit is committed to providing a secure and transparent payment process.
Our payment procedures are designed to:
- protect Buyers while they inspect their purchases;
- ensure Sellers receive payment promptly once transaction requirements have been met;
- reduce fraud and payment disputes; and
- maintain confidence in the Art is Lit marketplace.
13. Orders and Contract Formation
This section explains how orders are placed through the Art is Lit Platform and when a legally binding contract for the sale of Artwork is formed.
Art is Lit provides the Platform that enables Buyers and Sellers to enter into transactions. Unless expressly stated otherwise, the contract for the sale of Artwork is formed directly between the Buyer and the Seller.
13.1 Placing an Order
When a Buyer places an order through the Platform, the Buyer confirms that:
- all information provided is accurate and complete;
- they are authorised to use the selected payment method;
- they have reviewed the listing carefully before purchasing;
- they intend to purchase the Artwork at the displayed price; and
- they agree to these Terms and all applicable marketplace policies.
Placing an order does not automatically guarantee that the order has been accepted.
13.2 Order Confirmation
After an order has been placed, the Buyer will normally receive an acknowledgement confirming that the order request has been received.
This acknowledgement confirms receipt of the order but does not necessarily mean that the order has been accepted by the Seller.
Art is Lit may also send additional notifications regarding payment status, dispatch, delivery, or other updates relating to the order.
13.3 Acceptance of an Order
An order is normally accepted when:
- payment has been successfully authorised;
- the Seller confirms the order or dispatches the Artwork; and
- no legal, technical, security, or operational issue prevents the transaction from proceeding.
Where an order cannot be accepted, Art is Lit or the Seller will make reasonable efforts to notify the Buyer as soon as practicable.
13.4 Formation of the Sales Contract
Unless otherwise stated, the legally binding contract for the sale of the Artwork is formed directly between the Buyer and the Seller when the order is accepted.
Art is Lit is not generally a party to that sales contract but provides the Platform, payment infrastructure, customer support, and marketplace services that facilitate the transaction.
13.5 Refusal or Cancellation Before Dispatch
An order may be refused or cancelled before dispatch where, for example:
- payment authorisation fails;
- the Artwork is no longer available;
- an obvious pricing error has occurred;
- the listing contains a material error;
- fraud or unlawful activity is reasonably suspected;
- the Seller is unable to fulfil the order;
- applicable law prevents completion of the transaction; or
- completion of the order would expose Art is Lit, the Buyer, or the Seller to an unacceptable legal, financial, or security risk.
Where payment has already been taken, any approved refund will normally be processed using the original payment method.
13.6 Seller Cancellations
Where a Seller needs to cancel an accepted order, they should do so only where there is a genuine reason.
Examples include:
- accidental damage to the Artwork before dispatch;
- loss or theft of the Artwork;
- discovery of a significant listing error;
- circumstances beyond the Seller’s reasonable control; or
- another legitimate reason accepted by Art is Lit.
Repeated cancellations may affect the Seller’s account standing and performance metrics.
13.7 Buyer Cancellations
Buyers may request cancellation of an order before dispatch by contacting the Seller through the Platform or by contacting support@artislit.com.
Cancellation requests cannot be guaranteed once production has begun, the Artwork has been dispatched, or where the Artwork is personalised, commissioned, or otherwise exempt from cancellation under applicable law.
Any approved cancellation will be handled in accordance with these Terms and the Returns & Refunds Policy.
13.8 Order Records
Art is Lit may retain records relating to orders, payments, communications, and transactions for legitimate business purposes, legal compliance, fraud prevention, dispute resolution, and accounting requirements.
These records will be processed in accordance with our Privacy Policy.
13.9 Our Commitment
Art is Lit is committed to providing a clear, transparent, and reliable ordering process.
We aim to ensure that Buyers and Sellers understand when orders are placed, when contracts are formed, and how cancellations are managed, while supporting fair and efficient transactions across the Platform.
14. Shipping and Delivery
Art is Lit connects Buyers with independent Sellers who are responsible for preparing, packaging, and dispatching their Artwork.
This section explains the general responsibilities relating to shipping and delivery. Additional information is available in our Shipping Policy, which forms part of these Terms.
14.1 Seller Responsibilities
Unless otherwise stated, Sellers are responsible for:
- preparing Artwork for dispatch within the processing time stated in the listing;
- packaging Artwork appropriately to minimise the risk of damage during transit;
- using a reputable shipping service suitable for the nature and value of the Artwork;
- providing accurate dispatch information;
- supplying tracking information where available or required by the Platform; and
- complying with all applicable shipping, customs, and export requirements.
Sellers remain responsible for ensuring that the Artwork is packaged with reasonable care before it is handed to the shipping carrier.
14.2 Buyer Responsibilities
Buyers are responsible for:
- providing accurate delivery information;
- ensuring that the delivery address is complete and correct;
- monitoring shipment tracking where available;
- making reasonable arrangements to receive the delivery;
- inspecting the Artwork during the applicable Buyer Inspection Period; and
- complying with any customs or import requirements that apply in their country.
Art is Lit is not responsible for delays or additional costs arising from incorrect information provided by the Buyer.
14.3 Delivery Estimates
Estimated dispatch and delivery times are provided for guidance only.
Actual delivery times may vary due to factors outside the reasonable control of Art is Lit or the Seller, including:
- weather conditions;
- customs inspections;
- transport disruptions;
- public holidays;
- industrial action;
- carrier delays;
- security checks; or
- other unforeseen circumstances.
A delivery delay does not automatically entitle a Buyer to cancel an order or receive a refund unless required by applicable law or our Returns & Refunds Policy.
14.4 Tracked Shipping
Art is Lit strongly recommends that Sellers use tracked delivery services for all orders and may require tracked shipping for certain categories of Artwork or higher-value transactions.
Where tracking is required by the Platform or specified in the listing, Sellers must provide valid tracking information within the Seller Dashboard.
14.5 Risk and Ownership
Unless otherwise required by applicable law, ownership of the Artwork passes to the Buyer once full payment has been received and the transaction has been completed.
The allocation of risk during delivery, return, or collection will be determined in accordance with applicable law, our Returns & Refunds Policy, and the circumstances of the transaction.
Nothing in this section limits any statutory rights available to Buyers under applicable consumer protection legislation.
14.6 International Deliveries
Art is Lit supports international sales where permitted by applicable law.
International shipments may be subject to:
- customs inspections;
- import duties;
- VAT, GST, or other local taxes;
- brokerage charges;
- import restrictions; and
- additional delivery requirements imposed by the destination country.
Unless otherwise stated, Buyers are responsible for any import duties, taxes, customs charges, or similar fees payable in their country.

14.7 Failed or Undeliverable Deliveries
Where a delivery cannot be completed because:
- the Buyer provided an incorrect address;
- the parcel was not collected;
- delivery was repeatedly attempted without success;
- customs requirements were not completed; or
- the Buyer otherwise failed to cooperate with the delivery process,
additional shipping, storage, customs, or carrier charges may apply.
Refund eligibility will be determined in accordance with these Terms, the Returns & Refunds Policy, and applicable law.
14.8 Lost or Damaged Shipments
If an order is delayed, lost, or arrives damaged, Buyers should notify the Seller or Art is Lit as soon as reasonably practicable.
Art is Lit may request photographs, tracking information, or other evidence to assist with investigating the issue.
The handling of lost or damaged shipments is governed by our Returns & Refunds Policy and Shipping Policy.
14.9 Shipping Restrictions
Sellers are responsible for ensuring that the Artwork they dispatch complies with all applicable export laws and shipping restrictions.
Buyers are responsible for ensuring that Artwork may legally be imported into their country.
Art is Lit reserves the right to restrict or prohibit shipments to particular countries, territories, or regions where required by law, sanctions, security concerns, or operational requirements.
14.10 Our Commitment

We encourage the use of secure packaging, tracked delivery, and clear communication between Buyers and Sellers to help ensure that Artwork arrives safely and that any delivery issues can be resolved fairly and efficiently.
15. Buyer Inspection Period and Buyer Protection
Art is Lit is committed to creating a fair and trusted marketplace for both Buyers and Sellers.
To help achieve this, eligible orders are protected by a 48-hour Buyer Inspection Period, during which payment will normally remain on hold while the Buyer has an opportunity to inspect the Artwork after delivery.
This process is designed to provide Buyers with confidence while ensuring that Sellers receive payment promptly once the inspection period has concluded.
15.1 Buyer Inspection Period
The Buyer Inspection Period begins when the shipping carrier confirms that the Artwork has been delivered to the delivery address provided by the Buyer.
Unless otherwise stated, the inspection period lasts 48 hours from the carrier’s confirmed delivery.
During this period, Buyers should inspect the Artwork carefully to confirm that it:
- matches the listing description;
- is the correct item;
- has not been damaged during transit;
- includes any accessories, certificates, or accompanying items described in the listing; and
- does not have any other qualifying issue covered by the Returns & Refunds Policy.
15.2 Buyer Responsibilities
Buyers are responsible for:
- monitoring the shipment using the tracking information provided where available;
- ensuring reasonable arrangements are made to receive the delivery;
- inspecting the Artwork within the Buyer Inspection Period;
- reporting any qualifying issue before the inspection period expires; and
- providing supporting information or evidence where requested.
The Buyer Inspection Period is calculated from the carrier’s confirmed delivery and is not extended because the Buyer:
- is on holiday;
- is travelling;
- is unavailable;
- chooses not to open the parcel immediately; or
- delays inspecting the Artwork for personal reasons.
15.3 Seller Protection
During the Buyer Inspection Period, payment will normally remain temporarily unavailable for payout.
Where no qualifying issue has been reported within the applicable inspection period, the transaction will normally proceed to the Seller payout process in accordance with these Terms and the Seller Agreement.
This process helps protect Sellers from unnecessary payment delays while providing Buyers with a reasonable opportunity to inspect their purchase.
15.4 Reporting a Qualifying Issue
If the Buyer believes that a qualifying issue exists, they should report it through the Platform before the Buyer Inspection Period expires.
Examples of qualifying issues may include:
- the Artwork arrived damaged;
- the incorrect Artwork was supplied;
- the Artwork differs materially from the listing description;
- essential components included in the listing are missing; or
- another issue covered by the Returns & Refunds Policy.
Submitting a report does not automatically entitle the Buyer to a refund or other remedy.
Each case will be assessed individually in accordance with these Terms and the Returns & Refunds Policy.
15.5 Payment Hold During a Dispute
Where a qualifying issue has been reported within the Buyer Inspection Period, payment may remain on hold while the matter is investigated.
Art is Lit may request additional information from either party before determining the appropriate outcome.
Payment will normally be released, refunded, or otherwise dealt with once the dispute has been resolved.
15.6 Automatic Completion
If no qualifying issue is reported before the Buyer Inspection Period expires, the order will normally be treated as accepted for the purposes of the Platform.
Following the applicable payout holding period, payment will normally be released to the Seller in accordance with these Terms and the Seller Agreement.
Automatic completion does not affect any statutory rights that cannot legally be excluded under applicable consumer protection legislation.
15.7 Fair and Impartial Resolution
Where a dispute arises, Art is Lit will seek to act fairly and impartially.
We may:
- review information provided by both parties;
- request additional evidence;
- consider photographs, tracking records, and communications;
- consult relevant policies; and
- determine a fair outcome based on the available evidence and applicable law.
Our aim is to resolve disputes efficiently while protecting the legitimate interests of Buyers, Sellers, and the integrity of the Platform.
15.8 Relationship with the Returns & Refunds Policy
This section should be read together with our Returns & Refunds Policy.
Where additional procedures, evidence requirements, or return conditions apply, those requirements are set out in the Returns & Refunds Policy.
If there is any inconsistency between this section and mandatory consumer protection legislation, the applicable law will prevail.
15.9 Our Commitment
The Buyer Inspection Period is a key feature of the Art is Lit marketplace.
By temporarily holding payment while Buyers inspect their Artwork, we aim to:
- encourage confidence in purchasing original art online;
- provide Sellers with a clear and predictable payment process;
- reduce unnecessary disputes;
- discourage fraudulent claims; and
- maintain a trusted marketplace built on fairness, transparency, and respect.
16. Original Artwork, Handmade Items, Limited Editions and Authenticity
Art is Lit celebrates originality, creativity, and craftsmanship.
We encourage Sellers to present their Artwork honestly and accurately so that Buyers can make informed purchasing decisions with confidence.
This section sets out the standards that apply when listing original, handmade, limited edition, reproduced, personalised, commissioned, or other creative works on the Platform.
16.1 Seller Declarations
By listing Artwork on the Platform, the Seller confirms that the information provided is accurate and that the Artwork has been described honestly and in good faith.
Where applicable, Sellers should clearly state whether the Artwork is:
- an original work;
- handmade;
- a limited edition;
- an open edition;
- a reproduction or print;
- a digital download;
- personalised or commissioned;
- created using artificial intelligence (AI), where required by these Terms; or
- another type of creative work.
Sellers must not intentionally misrepresent the nature, origin, authorship, or authenticity of any Artwork.
16.2 Original Artwork
Where Artwork is described as original, the Seller represents that, to the best of their knowledge:
- it is an original creative work;
- they are the creator of the Artwork or have the legal authority to sell it;
- it has not been falsely represented as the work of another artist; and
- the description accurately reflects the nature of the Artwork.
Where an original Artwork forms part of a series or collection, this should be made clear in the listing.
16.3 Handmade Artwork
Art is Lit welcomes handmade Artwork created using traditional, contemporary, or mixed artistic techniques.
Because handmade Artwork is individually produced, Buyers acknowledge that minor variations in colour, texture, finish, glazing, wood grain, stitching, brushstrokes, resin patterns, fabric, natural stone, glass, ceramics, or other artistic characteristics are normal and do not usually constitute defects.
These natural variations contribute to the individuality and character of handmade Artwork.
16.4 Limited Editions
Where Artwork is advertised as a limited edition, Sellers should clearly state, where applicable:
- the edition size;
- the edition number;
- whether the Artwork is signed;
- whether a Certificate of Authenticity is included; and
- any other information reasonably necessary to describe the edition accurately.
Limited edition information must not be misleading.
16.5 Reproductions and Prints
Reproductions, prints, open editions, and other non-original versions of Artwork are welcome on the Platform, provided they are clearly identified.
Sellers must not describe reproductions, prints, or copies as original Artwork.
Listings should clearly distinguish between:
- original Artwork;
- limited editions;
- open editions;
- reproductions;
- fine art prints;
- giclée prints;
- photographic prints;
- digital reproductions; and
- other reproduction methods where relevant.
16.6 Certificates of Authenticity
Where a Seller provides a Certificate of Authenticity, the Seller is responsible for ensuring that the certificate is accurate and relates to the Artwork supplied.
Where a listing states that a Certificate of Authenticity is included, it should normally accompany the Artwork upon delivery.
Art is Lit does not independently verify the accuracy of Certificates of Authenticity unless expressly stated.
16.7 Authenticity Concerns
If a Buyer reasonably believes that Artwork has been misrepresented or is not authentic, they should report the matter through the Platform as soon as reasonably practicable.
Art is Lit may:
- request additional information from the Buyer or Seller;
- request supporting documentation;
- temporarily suspend the listing or transaction;
- seek an independent opinion where appropriate; or
- take any other reasonable action necessary to investigate the concern.
Knowingly misrepresenting the authenticity or origin of Artwork may result in listing removal, suspension of Seller privileges, termination of an Account, or other action under these Terms.
16.8 Artistic Style and Creative Expression
Art is Lit respects artistic freedom and does not judge Artwork based on artistic style, genre, subject matter, or creative approach, provided the Artwork complies with these Terms and applicable law.
Decisions relating to listing approval or removal are based on factors such as legality, authenticity, safety, marketplace standards, and compliance with Platform policies rather than subjective artistic preference.
16.9 Our Commitment
Art is Lit is committed to promoting honesty, transparency, and trust throughout the marketplace.
By encouraging accurate descriptions, clear declarations, and responsible selling practices, we aim to create an environment where Buyers can purchase with confidence and Sellers can showcase their creativity with pride.
Nothing in this section limits any statutory rights available under applicable consumer protection legislation.
17. Artificial Intelligence (AI) Generated Artwork
Art is Lit recognises that artificial intelligence (AI) is becoming an increasingly important tool within the creative industries.
We welcome innovation while remaining committed to transparency, authenticity, and helping Buyers make informed purchasing decisions.
This section sets out the requirements that apply where AI has been used in the creation of Artwork offered for sale through the Platform.
17.1 Transparency
Sellers must accurately disclose the role of artificial intelligence where AI has been used in creating or materially contributing to Artwork.
Where applicable, Sellers should clearly indicate whether the Artwork is:
- entirely created using AI;
- created using a combination of AI and human artistic input;
- digitally enhanced using AI tools;
- generated from prompts written by the Seller;
- edited or refined after AI generation; or
- created without the use of AI.
The description should be clear, honest, and not misleading.
17.2 Seller Responsibility
Regardless of the tools used to create Artwork, the Seller remains fully responsible for:
- the accuracy of the listing;
- compliance with these Terms;
- compliance with the Seller Agreement;
- ensuring they have the legal right to sell the Artwork;
- ensuring the Artwork does not knowingly infringe the intellectual property rights of others; and
- complying with all applicable laws and regulations.
The use of AI does not reduce or transfer these responsibilities.
17.3 Intellectual Property
Sellers are responsible for ensuring that Artwork created wholly or partly with AI may lawfully be sold and that they hold all necessary rights, licences, permissions, or authorisations required to offer the Artwork through the Platform.
Where questions arise regarding ownership, copyright, licensing, or other intellectual property rights, Sellers may be asked to provide additional information supporting their right to sell the Artwork.
17.4 Prohibited Uses of AI
Sellers must not use AI to create or sell Artwork that:
- infringes another person’s copyright, trade mark, publicity rights, or other intellectual property rights;
- falsely represents the work of another artist;
- deliberately deceives Buyers about the origin or creation of the Artwork;
- contains unlawful, defamatory, hateful, discriminatory, or abusive content;
- promotes illegal activities;
- violates applicable laws or regulations; or
- otherwise breaches these Terms or the Seller Agreement.
17.5 Human Creativity
Art is Lit recognises that many artists use AI as one of several creative tools within a wider artistic process.
The use of AI does not automatically reduce the artistic value of a work.
Similarly, Artwork created without AI is not automatically considered superior.
Our focus is on transparency, honesty, originality, and allowing Buyers to make informed purchasing decisions.
17.6 Marketplace Review
Art is Lit reserves the right to:
- request clarification regarding the creation process;
- request additional information where necessary;
- require updates to a listing where AI use has not been adequately disclosed;
- suspend or remove listings that breach these Terms;
- investigate reports relating to misleading AI disclosures; and
- take any other reasonable action necessary to protect the integrity of the Platform.
17.7 Future Developments
Artificial intelligence continues to evolve rapidly.
Art is Lit may update its AI requirements from time to time to reflect:
- changes in applicable law;
- developments in copyright and intellectual property law;
- advances in AI technology;
- industry best practice;
- user feedback; and
- the continued development of the Platform.
Where material changes are made, we will update these Terms and, where appropriate, notify affected Users.
17.8 Buyer Choice
Art is Lit believes Buyers should have sufficient information to make informed purchasing decisions.
Where AI has played a material role in creating Artwork, Sellers are expected to disclose this honestly so Buyers can decide whether the Artwork meets their personal preferences and expectations.
17.9 Our Commitment
Art is Lit supports creativity in all its forms while encouraging openness, fairness, and responsible innovation.
Our aim is not to favour or discourage any particular creative process but to promote trust by ensuring that Artwork is represented honestly and accurately.
By encouraging transparency and responsible use of AI, we seek to create a marketplace where Buyers and Sellers can engage with confidence while respecting creativity, intellectual property, and evolving technologies.
18. Intellectual Property Rights
Art is Lit is committed to respecting and protecting intellectual property rights.
We expect all Users to respect the creative work of others and to ensure that any content they upload, publish, sell, or otherwise make available through the Platform complies with applicable intellectual property laws.
18.1 Ownership of Artwork
Unless otherwise agreed in writing, Sellers retain ownership of the intellectual property rights in the Artwork they create and upload to the Platform.
Selling an item through Art is Lit transfers ownership of the physical Artwork (where applicable) to the Buyer but does not transfer the underlying intellectual property rights, including copyright, unless expressly stated in writing.
Nothing in these Terms grants a Buyer the right to reproduce, distribute, modify, publish, licence, commercially exploit, or otherwise use the Artwork beyond the rights granted under applicable law.
18.2 Licence Granted to Art is Lit
By uploading or publishing content on the Platform, the Seller grants Art is Lit a non-exclusive, worldwide, royalty-free, revocable licence to:
- display the Artwork on the Platform;
- promote the Artwork and the Seller;
- reproduce listing images for marketing the Platform;
- resize, crop, or optimise images for technical purposes;
- use the Artwork in newsletters, emails, social media, advertising, promotional campaigns, and other marketing materials relating to the Platform; and
- otherwise operate, maintain, improve, and promote the Platform.
This licence exists solely for the operation and promotion of Art is Lit and does not transfer ownership of the Seller’s intellectual property.
The licence ends within a reasonable period after the Artwork or Seller Account is removed from the Platform, except where continued use is reasonably necessary for legal compliance, dispute resolution, archived marketing materials, or legitimate business records.
18.3 Platform Intellectual Property
Unless otherwise stated, all intellectual property relating to the Art is Lit Platform, including:
- our name;
- logo;
- branding;
- website design;
- software;
- databases;
- text;
- graphics;
- icons;
- user interface;
- documentation; and
- other Platform content,
is owned by or licensed to Art is Lit and is protected by applicable intellectual property laws.
Users must not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any part of the Platform without our prior written permission, except where permitted by law.
18.4 Seller Responsibility
Sellers confirm that they:
- own the necessary intellectual property rights in the Artwork they list; or
- have all licences, permissions, and legal authority required to sell the Artwork.
Sellers must not upload or sell Artwork that:
- infringes another person’s copyright, trade mark, design right, patent, or other intellectual property right;
- copies another artist’s work without permission;
- falsely claims authorship;
- misuses protected brands, logos, or trade marks; or
- otherwise breaches applicable intellectual property laws.
18.5 Buyer Responsibilities
Buyers may enjoy purchased Artwork for personal use.
Unless expressly authorised by the copyright owner or permitted by law, Buyers must not:
- reproduce the Artwork;
- create copies for sale;
- use the Artwork commercially;
- distribute digital copies;
- create derivative works;
- use the Artwork for advertising or merchandising; or
- remove copyright notices or signatures.
Purchasing Artwork does not automatically include the transfer of copyright or commercial usage rights.
18.6 Copyright Complaints
If a person believes that content on the Platform infringes their intellectual property rights, they may submit a notice to Art is Lit.
The notice should include, where possible:
- details of the intellectual property concerned;
- the location of the allegedly infringing content;
- evidence supporting the claim;
- contact details for the complainant; and
- a statement confirming that the information provided is accurate and made in good faith.
Art is Lit may investigate the complaint and take appropriate action, including temporarily removing content while the matter is reviewed.
18.7 Repeat Infringers
Art is Lit reserves the right to suspend, restrict, or permanently remove Users who repeatedly infringe the intellectual property rights of others.
Repeated or deliberate infringement may also result in:
- removal of listings;
- suspension of Seller privileges;
- termination of an Account;
- cancellation of outstanding transactions where appropriate; and
- cooperation with rights holders or competent authorities where required by law.
18.8 Respect for Creativity
Art is Lit celebrates originality and creative expression.
We encourage Buyers and Sellers to respect the intellectual property rights of artists, designers, photographers, illustrators, makers, writers, and all other creators who contribute to our marketplace.
Maintaining respect for intellectual property helps protect creativity, supports independent artists, and strengthens confidence in the Art is Lit community.
18.9 Our Commitment
Art is Lit is committed to operating a marketplace that values originality, innovation, and respect for intellectual property.
Where concerns arise, we will investigate them fairly, impartially, and in accordance with applicable law, balancing the rights of creators, Buyers, Sellers, and other interested parties.
19. Reviews, Ratings and Community Standards
Art is Lit values honest feedback, respectful communication, and a supportive creative community.
Reviews and ratings help Buyers make informed purchasing decisions, recognise outstanding Sellers, and encourage high standards across the Platform.
All Users are expected to contribute to the marketplace in a respectful, honest, and constructive manner.
19.1 Reviews and Ratings
Following an eligible purchase, Buyers may be invited to leave a review and rating based on their genuine experience.
Reviews should reflect the Buyer’s honest opinion of:
- the Artwork received;
- the accuracy of the listing;
- packaging and presentation;
- communication with the Seller;
- dispatch and delivery experience; and
- overall customer service.
Reviews should relate only to the relevant transaction.
19.2 Honest Feedback
Reviews must:
- be truthful and based on genuine personal experience;
- be fair and accurate;
- remain relevant to the transaction;
- avoid offensive or abusive language; and
- comply with these Terms and applicable law.
Art is Lit encourages constructive feedback that helps Buyers and Sellers alike.
19.3 Prohibited Reviews
Users must not submit reviews that:
- are false or misleading;
- relate to transactions that did not occur;
- are intended to manipulate ratings;
- contain threats, harassment, discrimination, hate speech, or unlawful content;
- include confidential or personal information about another person;
- promote unrelated businesses, products, or services;
- contain spam, malicious links, or advertising; or
- otherwise breach these Terms or applicable law.
19.4 Fake Reviews and Review Manipulation
To maintain trust in the marketplace, Users must not:
- write reviews about their own listings;
- ask others to submit false or misleading reviews;
- offer money, gifts, discounts, or other incentives in exchange for positive reviews;
- threaten or pressure another User to change or remove a review;
- create multiple Accounts to influence ratings; or
- otherwise manipulate the review system.
Art is Lit reserves the right to investigate suspected review manipulation and take appropriate action.
19.5 Moderation of Reviews
Art is Lit does not routinely edit reviews simply because a User disagrees with them.
However, we may remove, restrict, or moderate reviews where we reasonably believe they:
- breach these Terms;
- contain unlawful content;
- are fraudulent or misleading;
- infringe another person’s rights;
- disclose confidential or personal information;
- are abusive or offensive; or
- otherwise undermine the integrity of the Platform.
Where appropriate, we may contact the reviewer before removing a review.
19.6 Seller Responses
Where supported by the Platform, Sellers may respond publicly to reviews.
Responses should remain professional, respectful, and focused on resolving concerns.
Sellers must not:
- disclose confidential customer information;
- threaten or intimidate Buyers;
- publish misleading statements; or
- use responses to harass or discourage honest feedback.
19.7 Community Standards
All Users are expected to treat one another with courtesy, honesty, and respect.
Users must not:
- harass, bully, intimidate, or threaten others;
- engage in discriminatory, hateful, or abusive conduct;
- publish defamatory or unlawful content;
- impersonate another person or organisation;
- deliberately disrupt the Platform;
- encourage unlawful behaviour; or
- misuse the Platform in any way that harms the Art is Lit community.
19.8 Reporting Concerns
Users may report reviews, messages, listings, or other content they believe breaches these Terms or applicable law.
Art is Lit may investigate reported content and request additional information where necessary before making a decision.
Submitting a report does not automatically result in content being removed.
19.9 Enforcement
Where a User breaches this section, Art is Lit may, acting reasonably:
- remove or restrict content;
- issue warnings;
- suspend reviews or messaging privileges;
- suspend or terminate an Account;
- remove listings;
- withhold Seller privileges where appropriate; or
- take any other action permitted under these Terms or applicable law.
19.10 Our Commitment
Art is Lit is committed to fostering a creative, inclusive, and respectful marketplace where Buyers and Sellers can engage with confidence.
By encouraging honest feedback, professional conduct, and meaningful communication, we aim to build a community founded on trust, creativity, fairness, and mutual respect.
Nothing in this section limits a User’s right to express genuine opinions, provided those opinions are lawful, truthful, and comply with these Terms.
20. Prohibited Activities
To maintain a safe, secure, and trusted marketplace, all Users must use the Platform responsibly and in accordance with these Terms, applicable law, and the values of the Art is Lit community.
Users must not engage in any activity that is unlawful, dishonest, deceptive, harmful, or likely to interfere with the operation, security, or reputation of the Platform.
20.1 Fraudulent or Deceptive Activity
Users must not:
- provide false, inaccurate, or misleading information;
- impersonate another person, business, or organisation;
- create fake identities or Accounts;
- submit fraudulent orders or transactions;
- misuse payment methods;
- attempt to obtain refunds dishonestly;
- engage in money laundering or other financial crime; or
- otherwise attempt to deceive Buyers, Sellers, Art is Lit, or third parties.
20.2 Intellectual Property Infringement
Users must not:
- upload or sell Artwork that infringes copyright, trade marks, design rights, patents, or other intellectual property rights;
- falsely claim ownership of another person’s creative work;
- copy, reproduce, or distribute another person’s Artwork without permission; or
- knowingly facilitate intellectual property infringement.
20.3 Unlawful or Harmful Content
Users must not upload, publish, distribute, or promote content that:
- is unlawful;
- is defamatory;
- contains hate speech or discriminatory material;
- promotes violence or criminal activity;
- contains obscene or sexually explicit material that is prohibited by applicable law or Platform policies;
- exploits or endangers children;
- encourages self-harm or suicide;
- contains malicious software or harmful code; or
- otherwise breaches these Terms or applicable law.
20.4 Marketplace Manipulation
Users must not:
- manipulate prices or listings;
- create fake sales or transactions;
- artificially inflate reviews or ratings;
- misuse promotional offers or discount codes;
- interfere with search results;
- attempt to gain an unfair commercial advantage over other Sellers; or
- engage in any practice intended to manipulate the operation of the marketplace.
20.5 Account Misuse
Users must not:
- access another person’s Account without permission;
- share login credentials where prohibited;
- create multiple Accounts to avoid restrictions;
- attempt to bypass security measures;
- interfere with authentication systems; or
- use automated methods to access the Platform without our prior written consent.
20.6 Platform Security
Users must not:
- attempt to gain unauthorised access to the Platform or its systems;
- interfere with the security, integrity, or performance of the Platform;
- introduce viruses, malware, ransomware, spyware, or other malicious code;
- conduct denial-of-service attacks or similar activities; or
- test or probe Platform security without our prior written authorisation.
20.7 Off-Platform Transactions
To help protect Buyers and Sellers, Users must not use the Platform to encourage or arrange transactions that deliberately avoid the Art is Lit checkout process for the purpose of avoiding marketplace commissions or Platform protections.
Nothing in this section prevents Users from maintaining their own independent websites or selling through other lawful channels, provided they do not misuse the Platform to divert transactions that originate through Art is Lit.
20.8 Misuse of Communications
Users must not use the Platform’s messaging or communication features to:
- send spam or unsolicited marketing communications;
- harass, threaten, or intimidate another User;
- distribute malicious links or harmful files;
- collect personal information without lawful authority;
- promote unrelated products or services; or
- engage in any unlawful or inappropriate communication.
20.9 Compliance with Laws
Users must comply with all applicable laws and regulations when using the Platform.
This includes laws relating to:
- consumer protection;
- intellectual property;
- data protection;
- taxation;
- financial crime;
- sanctions;
- export controls; and
- any other laws applicable to their activities.
20.10 Enforcement
Where Art is Lit reasonably believes that a User has breached this section, we may take appropriate action, including:
- issuing warnings;
- removing or restricting content;
- suspending or removing listings;
- delaying or withholding payouts where permitted by law;
- suspending or terminating Accounts;
- cancelling affected transactions where appropriate;
- reporting unlawful activity to payment providers, regulatory authorities, or law enforcement agencies where required or permitted by law; or
- taking any other reasonable action necessary to protect the Platform, its Users, or third parties.
Where appropriate and legally permitted, we will explain the reason for our decision and, where appropriate, provide the User with an opportunity to respond.
20.11 Our Commitment
Art is Lit is committed to maintaining a marketplace built on trust, creativity, fairness, and mutual respect.
These rules are designed not only to protect the Platform, but also to support the artists, Buyers, and creative businesses who rely on Art is Lit as a safe place to discover, share, and sell original creative work.
Nothing in this section limits any rights or remedies available to Art is Lit or any User under applicable law.
21. Account Suspension, Restriction and Termination

Where necessary to protect the Platform, comply with legal obligations, or enforce these Terms, we may suspend, restrict, or terminate an Account in accordance with this section.
Our aim is to act fairly, reasonably, and proportionately, taking into account the nature and seriousness of any issue.
21.1 Suspension or Restriction of an Account
Art is Lit may temporarily suspend or restrict an Account where we reasonably believe that it is necessary to:
- protect the security of the Platform;
- investigate suspected fraud or unlawful activity;
- investigate a reported breach of these Terms or the Seller Agreement;
- complete identity or business verification;
- protect Buyers, Sellers, or other Users;
- comply with applicable laws or regulatory requirements; or
- prevent financial, operational, or reputational harm to the Platform.
Restrictions may include limiting access to certain features, preventing new listings, delaying payouts, or temporarily disabling the Account while the matter is investigated.
21.2 Termination of an Account
Art is Lit may terminate an Account where, acting reasonably, we determine that a User has:
- committed a serious or repeated breach of these Terms;
- repeatedly failed to comply with the Seller Agreement;
- provided false or misleading information;
- engaged in fraudulent, unlawful, or deceptive conduct;
- seriously infringed the intellectual property rights of others;
- repeatedly failed to meet marketplace standards;
- attempted to compromise the security of the Platform; or
- otherwise created a significant legal, financial, operational, or reputational risk for Art is Lit or its Users.
Termination will normally be considered only where suspension, warnings, or other appropriate measures would not adequately protect the Platform or where immediate action is justified.
21.3 Immediate Action
Art is Lit may suspend or terminate an Account without prior notice where we reasonably believe that immediate action is necessary to:
- comply with applicable law;
- protect the safety or security of Users;
- prevent fraud or financial crime;
- respond to a court order or lawful request from a competent authority;
- prevent unauthorised access to the Platform; or
- reduce the risk of significant harm to the Platform or third parties.
21.4 Opportunity to Respond
Where appropriate and legally permitted, Art is Lit will:
- inform the User of the reason for the action taken;
- provide an opportunity to respond or provide further information; and
- review any relevant evidence before making a final decision.
There may be circumstances where we cannot disclose full details, including where doing so could prejudice an investigation, compromise security measures, infringe the rights of another person, or breach legal obligations.
21.5 Effect of Suspension or Termination
If an Account is suspended or terminated:
- access to the Account may be restricted or removed;
- listings may be hidden or removed from public view;
- outstanding payouts may be delayed while any necessary checks are completed;
- ongoing disputes or investigations may continue;
- existing legal obligations will remain in force; and
- Art is Lit may retain information where required by law or for legitimate business purposes, as explained in our Privacy Policy.
Termination of an Account does not automatically cancel completed orders, outstanding payment obligations, or any rights or liabilities that arose before the termination.
21.6 Closing Your Account
Users may request to close their Account at any time by following the procedures available on the Platform or by contacting support@artislit.com.
Before an Account is closed, Users should ensure that:
- all outstanding orders have been fulfilled;
- any disputes have been resolved where possible;
- payment information remains accurate until final payouts have been processed; and
- any outstanding fees or other contractual obligations have been satisfied.
Certain information may continue to be retained where required by law or for legitimate business purposes.
21.7 Appeals
If a User believes that their Account has been suspended or terminated in error, they may contact Art is Lit to request a review.
Art is Lit will consider any additional information provided and review the decision fairly and impartially.
Submitting an appeal does not guarantee that the original decision will be changed.
21.8 Our Commitment
Art is Lit values the creative community that uses the Platform and recognises the importance of fair treatment.
When enforcing these Terms, we aim to balance the rights and interests of Buyers, Sellers, and the wider community while protecting the security, integrity, and reputation of the Art is Lit marketplace.
Nothing in this section limits any rights or obligations arising under applicable law.
21. Account Suspension, Restriction and Termination

22. Limitation of Liability
This section explains the extent of Art is Lit’s responsibility for the services provided through the Platform.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
22.1 Marketplace Role
Art is Lit operates an online marketplace that enables Buyers and Sellers to connect and enter into transactions.
Unless expressly stated otherwise, Art is Lit is not the seller, manufacturer, creator, importer, exporter, distributor, or owner of the Artwork offered for sale by independent Sellers.
While we take reasonable steps to maintain a trusted marketplace, we do not control every aspect of the products or services offered by independent Sellers.
22.2 Information Published on the Platform
Art is Lit aims to ensure that information published on the Platform is accurate and up to date.
However, we cannot guarantee that:
- every listing is complete or error-free;
- all descriptions are entirely accurate;
- colours displayed on different devices will precisely match the Artwork received;
- all information supplied by Users is accurate at all times; or
- the Platform will always be free from typographical or technical errors.
Sellers remain responsible for the accuracy of their listings.
22.3 Availability of the Platform
Art is Lit will use reasonable efforts to maintain the availability, security, and functionality of the Platform.
However, we do not guarantee that the Platform will operate uninterrupted or be free from:
- temporary outages;
- maintenance;
- software defects;
- cyberattacks;
- internet failures;
- third-party service interruptions; or
- other events beyond our reasonable control.
We may suspend or restrict access where reasonably necessary to maintain, update, secure, or improve the Platform.
22.4 Third-Party Services
The Platform may rely on services provided by third parties, including:
- payment providers;
- delivery companies;
- hosting providers;
- authentication providers (such as Google or Facebook);
- communication providers; and
- other technology partners.
Art is Lit is not responsible for failures, delays, interruptions, or actions attributable solely to those third-party providers.
Nothing in this section affects any rights Users may have directly against those providers.
22.5 User Content
Art is Lit is not responsible for content created or uploaded by Users, including:
- product listings;
- descriptions;
- photographs;
- reviews;
- messages;
- comments; or
- other User-generated content.
Users remain responsible for the content they publish through the Platform.
22.6 Indirect Loss
To the fullest extent permitted by applicable law, Art is Lit shall not be liable for any indirect or consequential loss arising from the use of the Platform, including:
- loss of profits;
- loss of revenue;
- loss of business opportunities;
- loss of goodwill;
- loss of anticipated savings;
- loss of data; or
- business interruption,
unless such liability cannot legally be excluded.
22.7 Liability Cap
To the fullest extent permitted by applicable law, Art is Lit’s total liability arising out of or in connection with a particular transaction shall not exceed the total amount paid by the Buyer for that transaction.
This limitation does not apply where liability cannot legally be limited under applicable law.
22.8 Matters We Cannot Exclude
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any breach of statutory rights that cannot legally be excluded;
- any liability arising under applicable consumer protection legislation; or
- any other liability that cannot lawfully be excluded or limited.
22.9 Consumer Rights
Nothing in these Terms affects any statutory rights available to Consumers under applicable law, including the Consumer Rights Act 2015 or other mandatory consumer protection legislation.
Where these Terms conflict with mandatory legal rights, those mandatory rights will prevail to the extent of the conflict.
22.10 Our Commitment
Art is Lit is committed to operating a reliable, transparent, and trustworthy marketplace.
While we cannot guarantee that every transaction or aspect of the Platform will always be free from issues, we will act reasonably, fairly, and in accordance with applicable law when providing our services and resolving matters that arise.
23. Indemnity
Users are responsible for ensuring that their use of the Platform complies with these Terms, applicable laws, and the rights of other Users and third parties.
Where a User’s actions cause Art is Lit to suffer loss or become subject to legal claims, the User may be required to compensate Art is Lit in accordance with this section.
Nothing in this section limits any rights or remedies available to Art is Lit under applicable law.
23.1 User Responsibility
Each User agrees to use the Platform responsibly and accepts responsibility for their own actions, content, listings, communications, and transactions.
Users remain responsible for ensuring that their activities do not infringe the rights of others or breach these Terms.
23.2 Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify and keep indemnified Art is Lit, its directors, officers, employees, contractors, and authorised representatives against any reasonable losses, liabilities, damages, costs, expenses, or claims (including reasonable legal costs) arising directly from or in connection with:
- your breach of these Terms or the Seller Agreement;
- your breach of applicable law;
- your negligent, fraudulent, or unlawful conduct;
- infringement of another person’s intellectual property rights;
- inaccurate, misleading, or unlawful listings or content that you publish;
- misuse of the Platform;
- unauthorised use of another person’s Account or personal information; or
- any claim brought against Art is Lit arising directly from your acts or omissions.
This indemnity applies only to the extent that the relevant loss or claim has been caused by your actions or failure to comply with your legal or contractual obligations.
23.3 Seller-Specific Responsibilities
Without limiting the general indemnity above, Sellers may also be responsible for claims arising from:
- inaccurate product descriptions;
- counterfeit or unauthorised Artwork;
- infringement of copyright, trade marks, design rights, or other intellectual property rights;
- failure to comply with consumer protection legislation;
- failure to dispatch orders in accordance with these Terms;
- defective or unsafe products where responsibility rests with the Seller; or
- any other breach of the Seller Agreement.
23.4 Buyer-Specific Responsibilities
Without limiting the general indemnity above, Buyers may also be responsible for claims arising from:
- fraudulent payment disputes or chargebacks;
- misuse of the returns or refund process;
- unlawful use of purchased Artwork;
- abusive or unlawful conduct towards Sellers or other Users; or
- any other breach of these Terms.
23.5 Our Responsibilities
Nothing in this section requires a User to compensate Art is Lit for any loss that results solely from Art is Lit’s own negligence, fraud, breach of these Terms, or failure to comply with applicable law.
23.6 Notification and Cooperation
Where Art is Lit seeks to rely on this indemnity, we will normally:
- notify the User of the relevant claim or issue as soon as reasonably practicable;
- provide reasonable information about the claim where legally permitted; and
- allow the User to cooperate in resolving the matter where appropriate.
Nothing in this section prevents Art is Lit from taking immediate action where necessary to protect the Platform, comply with legal obligations, or minimise potential losses.
23.7 Survival
The obligations contained in this section will continue after an Account has been suspended or closed to the extent necessary to resolve outstanding claims, legal proceedings, investigations, or liabilities arising before the Account was closed.
23.8 Our Commitment
Art is Lit believes that responsibility should rest with the party whose actions caused the relevant loss or claim.
This indemnity is intended to allocate responsibility fairly, encourage responsible use of the Platform, and protect the integrity of the Art is Lit marketplace while respecting the rights of all Users under applicable law.
24. Privacy, Data Protection and Confidentiality
Art is Lit is committed to protecting the privacy, security, and confidentiality of the information entrusted to us by our Users.
This section should be read together with our Privacy Policy, which explains in greater detail how we collect, use, store, share, and protect Personal Information.
24.1 Privacy
Art is Lit processes Personal Information in accordance with:
- our Privacy Policy;
- the UK General Data Protection Regulation (UK GDPR);
- the Data Protection Act 2018; and
- any other applicable data protection legislation.
By using the Platform, you acknowledge that your Personal Information will be processed as described in our Privacy Policy.
24.2 Information We Collect
Art is Lit may collect and process information necessary to operate the Platform, including information provided when Users:
- create an Account;
- sign in using an email address or approved third-party authentication provider (such as Google or Facebook);
- purchase or sell Artwork;

- otherwise use our services.

24.3 Third-Party Services

During the course of using the Platform, Buyers, Sellers, and Art is Lit may receive information that is confidential in nature.
Users agree to treat confidential information responsibly and not to disclose or misuse such information except:
- where disclosure is authorised by the person to whom the information relates;
- where disclosure is required by law or a competent authority;
- where necessary to exercise legal rights or resolve a dispute; or
- where the information has already lawfully entered the public domain.
This obligation does not prevent Users from seeking independent legal, financial, or professional advice, provided that appropriate confidentiality is maintained.
24.6 Electronic Communications
By creating an Account or using the Platform, Users agree that Art is Lit may communicate with them electronically where permitted by law.
Communications may include:
- order confirmations;
- account notifications;
- security alerts;
- verification requests;
- updates to these Terms or other policies;
- service announcements; and
- other information relating to the operation of the Platform.
Marketing communications will only be sent where permitted by applicable law and may be withdrawn at any time using the unsubscribe options provided or by updating communication preferences.
24.7 Data Security
Art is Lit implements appropriate technical and organisational measures designed to protect Personal Information against unauthorised access, loss, misuse, alteration, or disclosure.
While we take reasonable steps to safeguard Personal Information, no online platform or method of electronic transmission can guarantee absolute security.
Users also play an important role in protecting their own information by maintaining the security of their Accounts and promptly reporting any suspected unauthorised access.

25. Force Majeure
Art is Lit recognises that exceptional events may occur which are beyond the reasonable control of Buyers, Sellers, or the Platform and may affect the ability to perform contractual obligations.
This section explains how such events will be treated.
25.1 Force Majeure Events
A Force Majeure Event means any event or circumstance beyond the reasonable control of the affected party that prevents or significantly delays the performance of its obligations.
Examples include, but are not limited to:
- natural disasters, including floods, earthquakes, storms, wildfires, or other severe weather events;
- war, armed conflict, terrorism, civil unrest, riots, or acts of sabotage;
- pandemics, epidemics, or public health emergencies;
- government actions, sanctions, embargoes, trade restrictions, or changes in applicable law;
- industrial action, strikes, lockouts, or labour disputes not involving the affected party’s own workforce where reasonably avoidable;
- interruption or failure of utilities, telecommunications networks, internet services, cloud infrastructure, or data centres;
- cyberattacks, ransomware attacks, or other significant cybersecurity incidents;
- widespread transportation or logistics disruptions; or
- any other event that could not reasonably have been anticipated or avoided.
25.2 Effect of a Force Majeure Event
Where a Force Majeure Event prevents or substantially delays a party from fulfilling its obligations under these Terms:
- the affected obligations may be suspended for the duration of the Force Majeure Event;
- the affected party will not normally be liable for delays or failures resulting directly from that event; and
- performance will resume as soon as reasonably practicable after the event has ended.
This applies only to the extent that the Force Majeure Event genuinely prevents or delays performance.
25.3 Duty to Mitigate
The affected party must take reasonable steps to minimise the impact of the Force Majeure Event and resume normal performance as soon as reasonably possible.
Where appropriate, Buyers, Sellers, and Art is Lit are encouraged to cooperate in finding practical solutions, including revised dispatch or delivery arrangements where feasible.
25.4 Notification
Where reasonably practicable, the affected party should notify the other party as soon as possible of:
- the nature of the Force Majeure Event;
- the obligations affected;
- the anticipated impact on performance; and
- any steps being taken to reduce the disruption.
Failure to provide immediate notice will not automatically prevent reliance on this section where notification was not reasonably possible.
25.5 Extended Force Majeure Events
Where a Force Majeure Event continues for an extended period and makes completion of a transaction impossible or impracticable, Art is Lit may, acting reasonably and in accordance with applicable law:
- cancel the affected order;
- facilitate an appropriate refund where applicable;
- delay performance until it becomes reasonably possible; or
- take any other fair and reasonable action to resolve the situation.
25.6 Consumer Rights
Nothing in this section limits or excludes any statutory rights that cannot legally be excluded under applicable law.
Where mandatory consumer protection legislation requires a different outcome, that legislation will prevail.
25.7 Our Commitment
Art is Lit understands that exceptional events can affect Buyers, Sellers, and the operation of the Platform.
Where a Force Majeure Event occurs, we will seek to communicate openly, act reasonably, and work with affected Users to minimise disruption while maintaining the safety, security, and integrity of the Art is Lit marketplace.
26. Changes to These Terms
Art is Lit may update these Terms from time to time to reflect changes in our services, marketplace operations, technology, legal or regulatory requirements, security measures, or business practices.
We are committed to making any changes fairly, transparently, and in accordance with applicable law.
26.1 Our Right to Update These Terms
We may amend these Terms where reasonably necessary, including to:
- improve or develop the Platform;
- introduce new products, services, or features;
- reflect changes in applicable laws or regulations;
- respond to guidance from regulators or payment providers;
- strengthen security or fraud prevention measures;
- improve clarity or correct errors; or
- protect the rights, safety, or legitimate interests of Art is Lit, Buyers, Sellers, or other Users.
26.2 Notification of Material Changes
Where we make changes that materially affect the rights or obligations of Users, we will take reasonable steps to notify affected Users before the changes take effect.
Notification may be provided by:
- email to the registered email address;
- a notice displayed on the Platform;
- an announcement within a User Account or Seller Dashboard; or
- another appropriate method of communication.
The method of notification may vary depending on the nature and significance of the changes.
26.3 Effective Date
Each updated version of these Terms will include a revised “Last Updated” date.
Unless otherwise stated, updated Terms will take effect from the date specified within the revised document.
26.4 Continued Use of the Platform
By continuing to access or use the Platform after updated Terms take effect, Users acknowledge that they have read and accepted the revised Terms.
If a User does not agree with a material change, they should stop using the Platform and may request to close their Account in accordance with these Terms.
This does not affect any rights or obligations that arose before the updated Terms came into effect.
26.5 Existing Transactions
Changes to these Terms will not normally affect orders that were accepted before the updated Terms became effective, unless:
- the change is required by applicable law;
- both parties agree to the change; or
- the change relates to an ongoing matter, such as dispute resolution, fraud prevention, security, or another issue where continued application is reasonably necessary.

As the Platform grows and new technologies, services, and legal requirements emerge, we will aim to keep these Terms clear, accessible, and transparent while balancing the interests of Buyers, Sellers, and the wider Art is Lit community.
27. Miscellaneous Provisions
This section contains general legal provisions that apply to these Terms and help ensure they continue to operate fairly and effectively.
27.1 Entire Agreement
These Terms, together with any documents expressly referred to within them, including the:
- Seller Agreement;
- Privacy Policy;
- Returns & Refunds Policy;
- Shipping Policy;
- Cookie Policy;
- Copyright & Intellectual Property Policy; and
- any other policies published by Art is Lit from time to time,
constitute the entire agreement between Art is Lit and the User regarding the use of the Platform.
They replace any previous agreements, understandings, or representations relating to the same subject matter, except where expressly stated otherwise.
Nothing in this section limits liability for fraud or fraudulent misrepresentation.
27.2 Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision shall be deemed severed to the minimum extent necessary.
The remaining provisions shall continue in full force and effect.
27.3 Waiver
If Art is Lit chooses not to enforce any right or provision of these Terms on one occasion, this does not constitute a waiver of that right or prevent us from enforcing it at a later date.
Any waiver must be made expressly and in writing.
27.4 Assignment
Users may not assign, transfer, or otherwise dispose of any rights or obligations under these Terms without the prior written consent of Art is Lit.
Art is Lit may assign, transfer, or subcontract its rights or obligations where reasonably necessary, including as part of:
- a company reorganisation;
- a merger or acquisition;
- the sale of all or part of our business;
- outsourcing of operational services; or
- another legitimate business purpose.
Any assignment will not reduce the legal rights of Users under these Terms or applicable law.
27.5 No Partnership or Agency
Nothing in these Terms creates:
- a partnership;
- joint venture;
- employment relationship;
- agency relationship; or
- franchise arrangement
