Art is Lit Marketplace Terms and Conditions

These Terms and Conditions govern the use of the Art is Lit marketplace (“Platform”), operated by Art is Lit (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms.

1. About Art is Lit

Art is Lit is an online marketplace that connects independent artists, makers, creators, and collectors. The Platform allows vendors to create storefronts, list artwork and creative products, and sell directly to customers.

Art is Lit acts as a marketplace facilitator and is not the creator, manufacturer, owner, or seller of the products listed by independent vendors unless explicitly stated otherwise.

2. Vendor Accounts

To sell on Art is Lit, vendors must:

  • Be at least 18 years old.
  • Provide accurate and complete registration information.
  • Maintain up-to-date account details.
  • Comply with all applicable laws and regulations.
  • Ensure that all artwork and content uploaded belongs to them or that they have the legal right to use it.

Art is Lit reserves the right to suspend or terminate vendor accounts that violate these Terms.

3. Vendor Responsibilities

Vendors are solely responsible for:

  • The products they list and sell.
  • Product descriptions, images, pricing, and availability.
  • Order fulfilment and shipping.
  • Customer service relating to their products.
  • Compliance with applicable consumer protection laws.
  • Compliance with intellectual property laws.
  • Maintaining appropriate records for their business activities.

Vendors must ensure that all listings are lawful, accurate, and do not infringe the rights of third parties.

4. Taxes and Financial Responsibilities

Art is Lit provides a marketplace platform and does not provide tax, legal, or accounting advice.

Vendors are solely responsible for ensuring compliance with their own tax obligations, including income tax, VAT, sales taxes, customs duties, and any other applicable taxes in their country or jurisdiction.

Each vendor is responsible for:

  • Determining whether they are required to register for VAT or similar taxes.
  • Charging and collecting taxes where legally required.
  • Filing tax returns.
  • Maintaining financial records.
  • Paying any taxes arising from their sales.

Art is Lit accepts no responsibility for a vendor’s tax obligations.

5. Marketplace Commission

Art is Lit charges vendors a commission fee on completed sales.

The applicable commission percentage will be displayed within the vendor dashboard or otherwise communicated to vendors.

Commission rates may be updated from time to time with reasonable notice.

6. Payments and Split Payment Model

Art is Lit operates using a marketplace commission model.

When a customer completes a purchase:

  1. The customer pays for the product through an approved payment gateway.
  2. The marketplace commission is automatically deducted.
  3. The remaining balance is allocated to the vendor.
  4. Payment processing fees may also apply depending on the payment provider.

Art is Lit may use third-party payment providers, including but not limited to:

  • Stripe Connect
  • PayPal Marketplace
  • Wise
  • Other approved payment processors

Payment processing is subject to the terms and conditions of the relevant payment provider.

Art is Lit does not guarantee uninterrupted access to third-party payment services and shall not be liable for delays caused by payment providers.

7. Orders and Contracts

The contract of sale for products listed on Art is Lit exists directly between the customer and the vendor.

Art is Lit is not a party to the sales contract and does not take ownership of products sold by independent vendors.

Vendors remain fully responsible for:

  • Product quality
  • Product descriptions
  • Packaging
  • Shipping
  • Returns
  • Refunds (where applicable)

8. Intellectual Property

Vendors retain ownership of their artwork, images, branding, and creative content.

By uploading content to Art is Lit, vendors grant Art is Lit a non-exclusive licence to:

  • Display products on the Platform.
  • Promote listings through marketing activities.
  • Use images and descriptions for marketplace promotion.

Vendors warrant that all uploaded content is original or used with permission.

9. Prohibited Content

The following are prohibited:

  • Counterfeit products.
  • Copyright-infringing material.
  • Offensive or unlawful content.
  • Misleading product descriptions.
  • Fraudulent activity.
  • Spam or unauthorised advertising.

Art is Lit reserves the right to remove content without notice.

10. Limitation of Liability

Art is Lit provides the Platform on an “as available” basis.

To the maximum extent permitted by law, Art is Lit shall not be liable for:

  • Loss of profits.
  • Loss of business opportunities.
  • Indirect or consequential damages.
  • Vendor disputes.
  • Customer disputes.
  • Payment provider failures.
  • Shipping delays.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

11. Account Suspension and Termination

Art is Lit may suspend or terminate accounts where users:

  • Breach these Terms.
  • Engage in fraudulent activity.
  • Violate intellectual property rights.
  • Damage the reputation of the Platform.

Termination may result in removal of listings and access restrictions.

12. Privacy

Use of the Platform is also governed by our Privacy Policy.

By using Art is Lit, users consent to the collection and processing of personal information as described in the Privacy Policy.

13. Changes to These Terms

Art is Lit may update these Terms from time to time.

Any changes will be published on the website and become effective upon publication.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
