Marketplace Standards

9. Curated Marketplace

Art is Lit is a curated marketplace dedicated to showcasing original, high-quality Artwork created by independent Artists.

Unlike open marketplaces, Art is Lit reserves the right to review Artist applications, Product Listings and marketplace content to ensure they meet our quality standards and align with our mission and values.

Acceptance onto the Platform is at the sole discretion of Art is Lit and does not create any guarantee of ongoing approval or continued access.

We may review Artists and their Product Listings periodically to maintain the quality, integrity and reputation of the marketplace.

10. Product Quality Standards

Artists are expected to present their Artwork professionally and accurately.

Product Listings should include:

  • a clear and accurate title;
  • a detailed description;
  • dimensions and materials where applicable;
  • accurate pricing;
  • realistic processing and dispatch times;
  • high-quality photographs;
  • any information that may reasonably influence a Buyer’s purchasing decision.

Artwork delivered to Buyers should match the Product Listing as closely as reasonably possible.

Listings that are misleading, incomplete or repeatedly fail to meet marketplace standards may be removed.

11. Originality and Authenticity

Art is Lit celebrates originality and respects the creative work of Artists.

Artists should only list Artwork that they have created themselves or that they have the legal right to sell.

Where applicable, Artists should clearly identify whether an item is:

  • an original work;
  • a limited edition;
  • an open edition;
  • a reproduction;
  • a commissioned piece;
  • a digital download.

Misrepresenting Artwork, including falsely describing reproductions as originals or providing inaccurate information about provenance or edition numbers, is prohibited.

Art is Lit may request evidence supporting claims of originality or authenticity where reasonably necessary.

12. AI-Generated and AI-Assisted Artwork

Art is Lit recognises that artificial intelligence can be a legitimate creative tool when used responsibly and transparently.

Artists must accurately disclose whether Artwork has been:

  • traditionally created;
  • digitally created;
  • AI-assisted; or
  • fully AI-generated.

Buyers should be able to make informed purchasing decisions based on clear and honest information.

Artists remain responsible for ensuring that AI-generated or AI-assisted Artwork complies with applicable copyright laws and does not infringe the intellectual property rights of others.

Failure to disclose the use of AI where it would reasonably affect a Buyer’s purchasing decision may result in the removal of listings or other action under our Platform Policies.

13. Intellectual Property and Copyright

Art is Lit respects intellectual property rights and expects all members of the community to do the same.

Artists must only upload content that they own or have permission to use.

This includes:

  • Artwork;
  • photographs;
  • product descriptions;
  • logos;
  • branding;
  • videos;
  • promotional materials.

Users must not upload or sell content that infringes another person’s copyright, trademark, design rights or other intellectual property rights.

If Art is Lit receives a legitimate complaint regarding alleged infringement, we may temporarily remove the relevant content while we investigate.

Repeated or serious infringement may result in suspension or permanent removal from the Platform.

14. Buyer Responsibilities

Buyers play an important role in maintaining a fair and respectful marketplace.

Buyers should:

  • read Product Listings carefully before placing an order;
  • ask questions before purchasing where clarification is required;
  • provide accurate delivery information;
  • make payment through the Platform;
  • inspect Artwork promptly following delivery;
  • communicate respectfully with Artists.

Buyers should not misuse the Platform’s Buyer Protection processes or submit false or misleading claims.

15. Reviews and Community Trust

Reviews help Buyers make informed decisions and encourage high standards across the marketplace.

Buyers are encouraged to leave honest, accurate and respectful feedback based on their genuine purchasing experience.

Artists should accept constructive feedback professionally and should never attempt to pressure Buyers into changing or removing reviews.

The following activities are prohibited:

  • fake reviews;
  • incentivised reviews that are not disclosed;
  • review manipulation;
  • retaliatory feedback;
  • harassment relating to reviews.

Art is Lit may remove reviews that breach these Platform Policies or applicable law.

16. Community Behaviour

Art is Lit is committed to fostering a welcoming, inclusive and respectful creative community.

All users are expected to:

  • communicate courteously;
  • respect differing artistic styles and opinions;
  • treat others fairly;
  • avoid abusive, threatening or discriminatory behaviour;
  • comply with all applicable laws and Platform Policies.

The following conduct is prohibited:

  • harassment;
  • bullying;
  • hate speech;
  • discrimination;
  • intimidation;
  • threats of violence;
  • abusive language;
  • unlawful activity.

Art is Lit reserves the right to investigate complaints relating to inappropriate behaviour and may take appropriate action, including issuing warnings, removing content, suspending accounts or permanently removing users from the Platform.

Buying, Selling and Marketplace Operations

17. Orders and Contracts

When a Buyer places an order through Art is Lit, a contract for the sale of the Artwork is formed directly between the Buyer and the Artist.

Art is Lit provides the Platform and payment infrastructure that enables these transactions but is not the seller of the Artwork unless expressly stated otherwise.

Artists are responsible for:

  • fulfilling accepted orders;
  • accurately describing their Artwork;
  • dispatching orders within the stated processing time;
  • communicating with Buyers regarding their orders.

Buyers are responsible for:

  • providing accurate delivery information;
  • making payment through the Platform;
  • reviewing Product Listings before purchasing;
  • complying with these Platform Policies.

18. Payments

To help protect both Buyers and Artists, all payments must be completed through the Art is Lit Platform using our approved payment provider.

Artists and Buyers must not arrange payment outside the Platform for transactions introduced through Art is Lit.

Attempting to complete sales outside the Platform in order to avoid marketplace fees or Platform protections may result in:

  • cancellation of marketplace privileges;
  • suspension of accounts;
  • permanent removal from the Platform.

Secure payment processing helps protect all parties and supports dispute resolution where necessary.

19. Shipping and Delivery

Artists are responsible for packaging, dispatching and shipping their Artwork safely and professionally.

Artists are encouraged to:

  • use tracked delivery services;
  • insure valuable Artwork;
  • provide tracking information promptly;
  • package fragile items appropriately.

Buyers should review the estimated processing and delivery times provided in the Product Listing before placing an order.

International deliveries may be subject to customs inspections, import duties, VAT, taxes or other charges imposed by the destination country. Unless otherwise stated in the Product Listing, these charges are the responsibility of the Buyer.

Further information is available in the Art is Lit Shipping Policy.

20. The 48-Hour Buyer Inspection Period

Art is Lit operates a 48-hour Buyer Inspection Period to balance Buyer protection with timely payment to Artists.

Once the shipping carrier confirms delivery, the Buyer has 48 hours to inspect the Artwork and report any qualifying issues through the Platform.

During this period, Buyers should check that:

  • the correct item has been received;
  • the Artwork matches the Product Listing;
  • the Artwork has arrived in the expected condition;
  • there are no significant defects or transit damage.

If no qualifying issue is reported within the inspection period, the order will normally be considered accepted and the Artist’s payment will become eligible for release in accordance with the Artist Terms & Conditions.

The inspection period does not extend because a Buyer is travelling, on holiday, working or chooses not to open the parcel within the 48-hour timeframe, except where required by applicable law.

21. Returns and Refunds

Art is Lit recognises that, on occasion, a return or refund may be appropriate.

All return requests are handled in accordance with the Art is Lit Return & Refund Policy.

Where a Buyer believes that Artwork:

  • arrived damaged;
  • is significantly different from its description;
  • is the wrong item; or
  • has another qualifying issue,

they should report the matter through the Platform within the applicable timeframe.

Artists are expected to cooperate fully in resolving legitimate claims fairly and promptly.

Art is Lit may assist in facilitating communication and reviewing evidence but is not a party to the sales contract between the Buyer and the Artist.

22. Reviews and Feedback

Honest reviews help maintain trust within the Art is Lit community.

Buyers are encouraged to leave accurate and constructive feedback based on their genuine purchasing experience.

Reviews should:

  • be truthful;
  • relate to the specific transaction;
  • remain respectful;
  • avoid offensive or abusive language.

Artists should respond professionally to feedback and should not attempt to pressure Buyers into changing or removing reviews.

Art is Lit reserves the right to remove reviews that:

  • are fraudulent;
  • contain hate speech or abusive content;
  • disclose personal information;
  • are unrelated to the transaction;
  • violate applicable law or these Platform Policies.

23. Marketplace Communication

Effective communication helps create a positive marketplace experience.

Users should communicate respectfully, honestly and professionally.

Artists should respond to Buyer enquiries within a reasonable timeframe whenever possible.

Buyers should communicate courteously and provide sufficient information when requesting assistance.

Users must not:

  • harass or intimidate others;
  • send spam or unsolicited marketing messages;
  • use offensive or discriminatory language;
  • misuse the Platform’s messaging system.

Art is Lit may review communications where reasonably necessary to investigate suspected fraud, abuse, policy breaches or legal complaints, in accordance with our Privacy Policy and applicable law.

24. Dispute Resolution

Art is Lit encourages Buyers and Artists to resolve concerns directly through respectful communication whenever possible.

Where this is not successful, Art is Lit may assist by:

  • reviewing information provided by both parties;
  • requesting photographs or supporting documentation;
  • considering tracking information and other available evidence;
  • applying the relevant Platform Policies consistently and fairly.

While Art is Lit may facilitate dispute resolution, we do not act as a court or arbitrator and reserve the right to make decisions based on the information reasonably available to us.

25. Marketplace Integrity

The success of Art is Lit depends on maintaining a trustworthy marketplace.

To protect our community, we actively discourage conduct that undermines confidence in the Platform, including:

  • fraudulent activity;
  • payment fraud;
  • counterfeit Artwork;
  • false claims;
  • manipulation of reviews;
  • repeated order cancellations without good reason;
  • misuse of Buyer Protection processes;
  • attempts to avoid marketplace fees;
  • repeated breaches of Platform Policies.

Where necessary, Art is Lit may investigate suspected misconduct and take appropriate action, including restricting accounts, removing listings, withholding payouts where permitted under our policies, or terminating access to the Platform.

  • temporarily remove Product Listings;
  • suspend selling privileges;
  • suspend Buyer or Artist accounts;
  • withhold payouts where permitted under the applicable Terms and Policies;
  • permanently remove users from the Platform.

Any action taken will be proportionate to the nature and seriousness of the issue and, where appropriate, users will be given an opportunity to respond.

27. Reporting Concerns

We encourage members of the Art is Lit community to report concerns that may affect the safety, legality or integrity of the Platform.

This may include concerns relating to:

  • abusive behaviour;
  • suspected scams;
  • payment fraud;

  • upload malicious software, viruses or harmful code;
  • use automated tools to scrape, copy or harvest content without permission;
  • attempt to bypass Platform security measures.

Any activity that threatens the security of the Platform may result in immediate suspension or termination of access and may be reported to the appropriate authorities where required by law.
